Thanks! C31 is filed only for an approved i360 petition correct?

We have a pending i360 with pending marriage i485 requested to be held in abeyance. So our category should be C09, correct?

If we put C09 as the category, do we still have to submit i-131 along with i765?

Uscis will issue category the work permit category C31AFTER  your VAWA is approved. If your l131 is still valid you don’t have to submit a new one,but keep in mind when you will renew your l131 USCIS night take a few months to issue the advance parole.

Thank you so much for quickly responding !!!! Yes putting together all those papers was one of the hardest things I did in my life. PAINFUL

I even added an extra page to my I485 to explain that I worked without authorization and I’m out of status. In that case it’s obvious I did a mistake with the YES/NO question. Hopefully they won’t make a big deal about it.

You just have to explain the immigration officer that you made a mistake when you filed your forms. After he asks you to swear them ask permission to say something and mention your mistake .

If you ticked the appropriate box, you will be getting C31 upon approval of your i360! For the pending i485 the correct EAD is C9/CO9 and yes you can file i-131 along side the i765..that's what gives you the CO9! But only i765 gives you C9! Understood?😊

Hello, please someone who can help me understand this: Since the USCIS page still does not update my case (I-485 through an approved vawa) I decided to call this number (800-375-5283) that I found in  Internet where they supposedly provide information about Stratus of cases but they informed me that they cannot give me information about my case, that if I want to know that I write to the postal address: vawa unit, 75 lower welden street, saint albans vermont 05479. I am worried  Because they didn't want to give me information, I'm afraid to think that the reason they didn't give me information is because I was denied I-485.  I understand that USCIS only does not provide information for Vawa cases (I-360) but for the rest of the applications they do provide information and that is why I am concerned. :(

The  VAWA case is protect by privacy law, and any petition pending with USCIS as well, this is just for  VAWA petitioners .

Okay, if we submit I765 + I131 with c09 category, will we get combo card only after VAWA approval or could we get it while i360 is pending also?

Hello. We have a pending i360 (filed in September 2019) and a pending marriage based i485 filed before i360 which we requested to hold in abeyence while filing for i360. We don't know the status of that i485 yet but I'm guessing USCIS will inform us once they've made a decision on I360?

Can we still file for EAD? Does anyone here have a checklist of things to be included? And since it has been over a year with pending i360, does it even make sense now to file for EAD given an approval might take months? Some feedback would be much appreicated.

(On a side note: Were pending i360 applicants eligible for stimulus checks this year?)

Yes USCIS will inform you the decision regarding your VAWA case. You can file form l-765 category C9.

Thank you for this! How do we know if EAD fees could be waived? Do we submit i360 receipt form along with it to request for waiver?

When applying first time for EAD, will the applicant be fingerprinted in the future or will the fingerprints from pending marriage i485 be used for EAD processing?

If you paid the l485 fee then  you don’t have to pay to renew  l765 category C9, but if you are submitting the l765 for the first time, after you submitted the l485,then pay the fee or submit form l912 asking to waive the fee, you need to prove you don’t have money to pay them.

The only EAD you can get while your vawa is pending is the one under i485 which is the C9/CO9..you can only get C31 after your vawa has been approved. Please pay close attention to my responses. Yes you can file i-131 and i765 which is equal to= CO9 and get it under i485 while your vawa is pending!👍

Thank you  so much for the information and I apologize as the process is complicated and our attorney has often given us confliction information than whats provided here. It's been one year since we filed for i360 and my relative has had a very tough time due to inability to do anything ever since - no ead, no ssn, no job. Just hoping the finish line isn't too far out.

Would this be sufficient reason to apply for fee waiver for EAD combo card? Joblessness since filing of i360 due to no EAD

If you can demonstrate/prove your hardship and include the waiver I912 then you may be considered. You can do this by convincing them you do not have a job...obviouly no EAD, show bills and bank statements that emphasizes your helpless situation..those will help prove your case too.👍

I’m preparing for my AOS interview as I mentioned a couple days ago...

I’m going over my I485 that I submitted with my I360 and I just noticed I answered one of the yes or no questions in my I485 wrong :( I’m a little freaking out.

PART 8 - Question 16 - “Have you ever worked in the U.S. without authorization?” I answered NO but I did work without authorization.

PART 8 - Question 17 - ”Have you ever violated the terms and conditions of your nonimmigrant status?” I answered YES to this regarding my working without authorization.

Can someone please tell me if I can clarify this with the officer during my interview? I can’t believe I put this wrong :( my interview is on the 22nd of October.

@Stillwinning!!!😊 @Pinkrlion @sandranj  @Villanelle @TBoneTX

When they ask you the questions again during the interview you can correct your answer.  I believe that @sandranj said before that VAWA is forgiven for unauthorized work.

Hello everyone

I hope everyone is safety and good!

im new here on this forum and I hope I can express my self correct so I can get help from you all!

I filled  up for I-360 on 05/06/2018 and RFE was received on 09/21/2018 and since that nothing haven changed on my cases!

my lawyer applied again this month for my 3rd EAD and USCIS denied my form I-131 for travel documentation! I was in my country this year with my current EAD with travel permit which is gonna expired 01/13/2021!

what you guys thinking ? You guys think I can travel with my current EAD?

I’m so sad cause I’m paying my lawyer $13k yes that’s a lotttt money I’m getting crazy to pay then and when I need information about my case they treat me like nothing !

131 can only be approved when you are in the US. You can apply for it again once you are back in the US. You will be able to enter the US using your unexpired travel permit as long as you enter before it expires 1/13/21. Do not wait until the last day to travel back. Flights can be delayed or canceled.
