Hello. We have a pending i360 (filed in September 2019) and a pending marriage based i485 filed before i360 which we requested to hold in abeyence while filing for i360. We don't know the status of that i485 yet but I'm guessing USCIS will inform us once they've made a decision on I360? 

Can we still file for EAD? Does anyone here have a checklist of things to be included? And since it has been over a year with pending i360, does it even make sense now to file for EAD given an approval might take months? Some feedback would be much appreicated.

(On a side note: Were pending i360 applicants eligible for stimulus checks this year?)

Sure you can go ahead and file i765(C9) under the pending i485. Here's what you need👇👇👇

 

EAD Application Documents
  • Fee payment, unless required or waived. ...($410)
  • Form I-765, Application for Employment Authorization.
  • Receipt notice for the pending I-485
  • A copy of Form I-94, non-immigrant arrival/departure record, if available.
  • A copy of your last EAD (front and back), if available.
  • 2 identical photographs.

Thank you for this! How do we know if EAD fees could be waived? Do we submit i360 receipt form along with it to request for waiver? 

When applying first time for EAD, will the applicant be fingerprinted in the future or will the fingerprints from pending marriage i485 be used for EAD processing?

The form is i765! If you submit the Form I-765 with an immediate family based green card application (Form I-485), then the fee is automatically waived. If you're filing the Form I-765 separately, the filing fee is $410. You must also pay an additional $85 biometric services fee, for a total of $495.👍

Yeah I do have mail forwarding but for some reason the mailman don't forward it, it is very frustrating 😒

Thank you. So we fill file for i765 based on pending i485. My online concern is that since we requested for pending i485 to be held in abeyance on our i360 cover letter, we don't know that status of that i485 yet, that is if they will hold it or ask us to apply for new one in the future. Can we still apply for EAD on pending i485 without knowing if its truly going to be held in abeyance? 

Do we email our EAD application to VSC? Sorry for so many questions!

Yes VSC. Yes you can file the i765 under the pending i485. If you asked the officer to hold the i485..then it's done. In your free time try to go through previous threads so you get really familiar with the whole process. Of course don't hold back if you have any more questions..feel free!😊👍

Good idea!👍 So the only document you have now is the i360 notice of action and probably prima facie..you may include the C31 EAD!👍

You can check your local courts policy (where you had the divorce done). Every state that I know of has the same general policy but I can not say 100% they all do- but the general policy for stuff like birth certificates or divorce filings is that you have to be one of the parties involved. Meaning I can not simply go down and request a copy of my neighbors birth certificate or divorce filings. You can get your own birth certificate or your parents can get it. You and your ex can both get copies of the divorce. But anyone else either needs permission from you or permission from a court to get a copy of it. 

 

Public records are public but that just means a one line description of the event. Like when they post in the newspaper so and so was born or a couple divorced. The actual documents though are protected for privacy. To get documents for something you are not involved in you typically need to get a court order where you would argue to the court that its in public interest or the contents are already known publicly. You see this sometimes when those gossip magazines or TV shows run a story that says exclusive we obtain copies of the filings between Johnny Depp and whatever the girls name is. That news outlet went to court and got approved to get a copy of the filings because of who it involved. 

 

So you really do not have to worry that anyone in your life would be able to obtain copies of your divorce papers and read all the specifics about asset divisions and such. The most they can find is the one line statement of X and Y were divorced on X date at X place.

I can PM you a link that has a sample affidavit if you need it. We dont post sample affidavits here because its VERY important that your affidavit is written in your own words and is not a cut and paste of a sample with just the names and dates changed. So I can PM you a sample but only use it as a reference!!

USCIS mail can not be forwarded. Its printed on the envelope. Do not forward, return to sender. You MUST change your address with the post office. If you do not have a stable address there are various DV groups that provide PO boxes or mailing addresses you can use if you dont have a friend or relative available that you can use their address as a mailing address in care of your name. You can also open your own PO box. USCIS will mail to PO boxes as your mailing address but they also require your physical address (you cant live in a PO box!).
