every time when you apply for a renewal of your EAD you have to apply also for your advance parole, otherwise they wont issue you a combo card.

I already have one with advance parole I received 3 weeks ago. Today I received another one without AP. So I have 3 cards now. Two C09 with and without AP and one for my c31. All are still active and Will expire next year, only 2 months gap.

Timeline

I-360 sent April 2018 received Prima facie..

renew my EAD 2 times

I-360 approved february 2020 received approval letter and C31 card march 2020

06/2020 received courtesy letter

End of 07/2020 Case ready for interview.

09/2020 Interview was schedule for October 2020

went to interview with my lawyer officer was super nice, he only ask me the questions on I-485 and then review my paperwork that I brought but didn't take anything other than the divorce decree.

By the end of the interview day. I-485 status change to "New card is being produced"

Next day "Case was approved".

 

I wish all of you to get approve on I-360 and I-485. This journey was super super hard for me but I always believe in the power of the ALMIGHTY. You just need patience lots of patience and keep praying.

Hi everyone ! A little bit off topic but I would appreciate if anyone has an idea how to find a spouse if you have not been in contact for a year. My vawa was approved and now want to file for divorce but I have no idea wHere he is at the moment. I don't want to be in contact with him though.

Mine I found him on (removed). I did their 3 day trial for 1 dollar. Copied everything, his address etc. And then cancel before the trial by calling (you have to call) so won't  be charged $39. I found him through that. Will be serving him the divorce papers next week.

I understand why you would want such a guide written but its not a good idea. You dont want to rehearse answers, it's usually very obvious to the listener when someone is doing that vs speaking naturally. It will give a bad impression. The 485 interview should be more of a formality then an interrogation. You should review your copy of the 485 you sent. They most likely will read out loud a few questions from the 485 that you would answer yes or no to. They may ask you questions confirming dates or addresses you entered. So read it over ahead of time and make sure you understand all the questions from part 8, especially if English is not your first language. Refresh your memory about your address and work history. They may make small talk with you about your job or kids. They may ask if you are divorced. They are NOT suppose to ask you about the abuse. Your 360 was approved so a determination was already made that you are a victim of abuse. Some Officers ask inappropriate questions about the abuse anyway. Answer politely and truthfully if they do and keep it brief and they will most likely move on. 

 

To mentally prepare remind yourself that you were already approved as a victim of abuse, that this interview is not about showing you were abused. Its about confirming you are eligible to receive a GC. To get a GC you need an approved underlying form. You have that- the 360. So now they just have to go through and make sure there are no reasons why you shouldnt get a GC (inadmissibility reasons). As stillwinning explained inadmissibility reasons are stuff like criminal records, drugs, terrorism. Pretty much all the stuff in part 8 that you said no to. Generally people with inadmissibility issues know they have an issue. They are usually serious and significant things. Part 8 lists out all the general eligibility things and the things that are grounds for inadmissibility. VAWA laws can override some so if you did check yes to something under Part 8 dont panic! its not an automatic denial. So if you do have any yes boxes checked in part 8 you can confirm here with Sandra or other users that it wont be an issue.  If you have no yes boxes checked off then theres no reason for your 485 to be denied and you shouldnt stress yourself about the interview unnecessarily.

You need to speak with the clerk where you will be filing the divorce. Every place has different processes. In general you are required to serve the other person through mail or a process server (thats a 3rd party that delivers it to them in person). There are a variety of places that may be able to help you (for a fee) in tracking him down and serving him the papers. Most courts will require you attempt to use what they call 'reasonable efforts' to locate them. In some places doing a google search is enough. Other places may require you to show you hired professional assistance and they failed. Once you show you made 'reasonable efforts' and the persons location is still unknown they will allow you to do what is called 'alternative service'. That usually means a publication in the newspaper. The clerk will be able to explain to you exactly what you need to do. You can also check their website as this information may be posted on it. 

 

You should also do a google search of your name + his to see if he filed for divorce anywhere already. You said you do not know where he is but does he know where you are? If he was unable to locate you then the same process would apply for him filing for divorce. You would be able to find online if he did file and you were served via publication.

Also if you are not familiar with google alerts I strongly advise you to look into it. Google alerts is a feature where you can enter a search term (like someones name) and when a new search result comes up they will email you. So you dont have to google him every day. Google will let you know when theres a new result. 

Personally I think google alerts is a blessing and a curse. Ive used it in the past to be able to keep tabs on my abusive ex but at the same time it horrifies me to think they can be doing the same and silently be stalking me. I also have an extended family member who is incredibly nosy. She has set alerts for everyone in the family. A kid makes honor roll or scores some points in the game and its posted on the schools website. She gets a google alert and I get a random passive aggressive message about how well we all are doing and its a shame she has to read about this accomplishment online instead of being told directly! Drives me nuts.
