So on February 4th, the police helped me leave, on February 18th I went to USCIS alone, told them what happened and that I intend to file a VAWA petition. They told me that they will keep my case open and that I can keep the EAD for now. And then Covid hit, and it took me a while to battle the restraining order hearing while looking for a lawyer.. By June I had my case ready to send, with a lot of good evidence: pictures, pictures of the abuse, letter from the therapist, letter from two domestic violence organizations who has been helping me, letter from my restraining order pro-bono lawyer, police report, affidavits from friends and family, even from our neighbour. I felt really good about filing the case, only to get a letter from my local USCIS in San Jose, Ca, saying that they have recieved a request from my ex to close my case and decided to deny my I-485 and withdraw my EAD.... I replied within 30 days saying that I filed with Vermont Service Centre already, asked them to keep the I-485 open, but only silence back. 

The job that I had is still paying for my insurance even though i havent been working there since June, I fear they will stop soon and I am still in need of a lot of medical help for my arm that my husband broke. So I am freaking out that they are not answering, and they I am not getting my EAD back. Can I by any chance file for a new EAD based on my VAWA case now? My VAWA was filed in June 2020 without I-765 and without I-485 since I thought I still had both.

First, big hugs 🤗🤗  I feel you. 
 

second, you have the receipt for the I-485 that you filed with your husband right? It has your receipt and lien number that will come handy for- CONTACT your congressman/women or senator. Google who is your representative and contact their office via phone. Tell them that you need them to contact USCIS ON YOUR BELAF FOR AN INQUIRY about your case. They will then send you a waiver to sign and some additional info as a privacy waiver ( don’t worry, it’s still confidential, they do not share your info with anyone else in the office who is not directly working on your query) 

 

ask them to check if your I-495, identified by the unique receipt number, is held in abeyance till your 360 is processed and if not, to do that if still possible. 
 

in the meantime, be prepared to hear that it has not been held and definitely file a new one. 
 

I do think there is a good chance that they held it as you explained the officer about what happened they must have put this down/ made a note of it. 
 

good luck, hang in there. If you do loose insurance, you can: 

a. If have a prima facia, apply for state funded healthcare, check your state’s requirements 

 

b. Look for community centers, hospitals and hospital systems who offer “charity care” or provide services at sliding scale. To uninsured individuals

yes i applied all together 

I don’t know it fees were waived or no .. how can i know ?? 
I remembered last time my lawyer asked me for $200 to file the renewal for me .. he didn’t ask for more !

Can you ask your lawyer to give a copy of your file he has or else you can get copy of what USCIS has through freedom of information act but, that is a time consuming process. Best to get the information from your lawyer then fill out the application.

I’m keeping you in prayers. No woman should suffer abuse, but sadly it’s the tie that binds us on here. I agree with @Stillwinning!!!😊 on filing a new I-485 and I-765. I’m seeing EAD approvals within 3-6 months on here. My last EAD renewal took about 3 months. Don’t forget worry about him anymore, because his time has passed. It’s time for your healing and victory. You’ll see that this too shall pass. Let him erratic himself from your life because you no longer need him. God bless and stay safe.

Expired approved vawa?😏 Doesn't sound right..an approved petition doesn't have a validity period..go ahead and apply for your C31 EAD!😊👍

Just received this from my local congressman: 

 

USCIS records indicate that the petition in question requires an interview. Due to the uncertainty of the current COVID-19 situation, we are unable to provide him with a precise appointment date and time. Once a date becomes available, he will be scheduled and notified accordingly.


-Vawa approved March 2020

-July 2020 congressman notifed me that the local office received my file from Vermont

-NYC, Queens


so I guess I have to play a long waiting game, patiently waiting for this to be finalized once and for all..

So many NYC cases approved 2018 and '19 still waiting for interview...it's not nearly half the time for you to freak out yet. You're well within good time! Be patient.👍

Way before things turned topsy turvy, I got my prima facie within 2weeks alongside my receipt notice. But it's pretty normal and common these days to wait longer than you have already. If you're talking about EAD from i485 petition, then you're looking at anywhere from 4-6 or even 7,8 months. With uscis, expect anything..so be patient and see what tomorrow brings.👍

It took me 6 months to get my first one.  It just showed up in the mail.

I am still waiting for my interview, it was scheduled back in April but due to the COVID-19 situation... got canceled... so now patiently waiting, my VAWA was approved May 2019, Filled Nov 2017

Are you talking about the deferred action??? That comes with the approval letter... good for 15 months???
