Unless you have some other ban like a CIMT, immigration fraud, alien smuggling, communicable disease, or somehow have a 10 year bar that you managed to skirt around with a 212(d)(3) waiver for a non-immigrant visa or got admitted in error by CBP, or have the permanent bar for an unlawful re-entry then no.

The 3 and 10 year bars for unlawful presence does not trigger unless you overstay for more than 180 days AND leave the US, if you never left there's no bar.

I overstayed more than 180 days and currently I’m still in U.S. I went to visit my family with AP twice, I don’t know if that counts as “leaving the U.S.”?

No, that's fine. As per Matter of Arrabally (BIA, 2012) travel on advance parole after an overstay does not trigger this re-entry bar.

Contradictions without citations only make you look dumb.

My lawyer never applied for c09 , she only did c31 . I did ask her so many times but all i got that she will get mad at me for telling how to do her job properly.

you still can apply i-765(c9) but for this to go through you need to find out if you lawyer filed your i-485 with your i-360. You might get your (c31) EAD before the (c9) approval but keep in mind (c31) EAD you have to pay or send a fee waiver in order for it to process.

Hi everyone. Hope you all are doing well. What advice would you give to someone who has not received any updates/news from USCIS - yet, for the I-485 application timeline for my borough in NYC they are already processing October 2017. My application was received in August 2017.

Is it a good idea to be proactive and make a case inquiry with the USCIS or write a letter to the Vermont Service Center. Should I contact my Congressman? I’m not sure what to do. I filed 1-360, I-765 &

I-485 in August 2017 and my VAWA was approved on March 2019. I’m in NYC.

I’m uncertain about what next steps to take. Given that there was already a backlog in cases previously which has only intensified with Covid-19 - what is the best course of action to take?

My EAD expires in March 2020. I think I can only apply 90 days in advance. I hope that if I file for EAD extension in Jan, I can get the receipt notice in a timely manner.

I would appreciate any advice or feedback from you guys. Thank you in advance for your time and consideration. 🙏

Have a good night.

even though the renewal  time was 90 days as USCIS is backed up with cases their processing times have gone up 4.5 months to 6.5 months so you can apply 5 to 6 months before in order to guarantee a timely EAD.

Hey..my vawa was also approved in March 2019..got the interview March 2020 before all the craziness started..I think it has to do with the pace at the field office..even before the pandemic, the Bronx and Brooklyn offices took the longest respectively with the former taking the lead..now with the pandemic..it's a whole new dimension! I like proactive..and as such wouldn't advice you not to enquire..go ahead and do so..even though some folks did and got responses citing the pandemic as cause of delay!💁#also I responded to your earlier enquiry in the inbox.😊👍

Hi everyone I recently got my vawa approved but I’m in removal proceedings . I know I adjust in front a judge but is it going to be at the first court date to let them know I’m approved ( been there about twice for master hearing ) or are they gonna schedule me for an individual hearing for the adjusting of status . What should I expect and will he be asking about vawa or just green card questions

Thank you. I thought so - I was worried about a gap in employment because I saw people saying that it took them 3 to 6 months, if not more to get a reply etc.

Hello, can anyone recommend some experienced vawa lawyers? We have our i360 filed in September 2019. But we are just not satisfied with our attorney’s service due to poor communication from his end.

@sandranj is the best VAWA lawyer I know.
