@sandranj I’m sorry for bothering you but can you please advice. Can I do my medical exam now since I’m out of a job and I want to take advantage of my health insurance before they take it away. My VAWA was approved in September of 2019? Still waiting on my interview but I want to try and save some money.

I filed I360, I765 and I131 on July 22, 2020. My I485 was already pending since July 2019 based on I130. The case status was: ready to be scheduled for an interview, so it was already in a local office.

I also filed i765 and i131 along with i485 back in 2019, but it had been more than a year, and they never got approved. I don’t know why. 
After I filed VAWA I received NOA that they received my i360, new I765 and new i131, then a few days ago I got notices for I485, old I765 and old I131 that they were successfully transferred to VAWA department. 
 

Basically, I have two I765 pending (both C09 category) and two I131 pending at VSC. My story even more complicated haha. I have EAD card from my F1 student status that is valid until spring 2021. I’m still maintaining my student status.
 

My questions are:

 

1) How long did you guys wait for your i765 (C09) and i131 approvals through VAWA? 
2) Is it safe to travel with i131? It has been almost 4 years since I was in my home country.

3) Is it smart to travel while pregnant? Or would you wait until baby is born? 
4) How long did you wait for VAWA prima facie? And what this document for?

1- 8/9 months.

 

2-Many people travelled and returned with our problem. DO NOT TRAVEL IF YOU FILED FOR ASYLUM or if you are in removal proceedings. You have to check the restrictions regarding the COVID 19.

3-Do not travel if you are 6/7 months  pregnant.

4- USCIS takes 20/60 days to issue the Prima facie.

All congressman require a confidentiality waiver for ANY type of case you want them to help you with.  USCIS can not discuss your case (any type of case) with anyone besides you or your attny on record. The waiver you sign for the congressman allows them to speak with USCIS about your case on your behalf. They are not going to ask USCIS random things behind your back and honestly have no interest in the specifics of your case. They help tons of people every day in dealing with USCIS and its usually just inquiring on the status of things or confirming where your package is in the process or assisting with confirming an address is corrected. The congressman does not provide legal assistance like an attny would. 

 

If you are imagining that you sign the congressman release waiver and USCIS then sends a copy of your filing to the congressman - thats incorrect. The congressman sends a specific inquiry to USCIS and USCIS responds to it. To get a copy of your A file you need to send a specific form (FOIA- freedom of info act) that you sign. Someone else can also request your file but you would also need to sign the form allowing them to do so. Your signature needs to be notarized so do not worry that someone would be able to do this w/o your consent. The waiver for the congressman does not override that. 

 

Do not be afraid to use the congressman if you need to. If you do not have an attny the only way you can get any information on your case is by writing to Vermont. Sending stuff to them through the mail is a slow process. It will take a while for them to get it and to actually respond. You may get a vague response or a response that didnt answer your question or issue. If so you have to write back and wait again for a response. The congressman can contact them very quickly and gets the response back quickly as well.

Did you get the NOA for the 360 in addition to the C31 EAD? Its very odd to get an RFE after approval. Just FYI the online system is a courtesy system and is not always accurate. Often people get odd status updates on it due to computer glitches.  Keep an eye on your mail - sign up for informed delivery from the post office if you arent signed up for it yet. The post office will email you daily with what they are going to be putting in your mailbox. If you dont get any RFE by the date shown you can try using the e-request link they show you but I am not sure if you would be able to due to VAWA being confidential and everything needing to be on paper through VSC. So I would suggest if you dont get any RFE by that date to use your congressman to inquire about it. They can obtain the RFE if there is one or confirm that the status update was an error.

The medical exam is valid for 2 years since 2018, but you have no more than 60 days from the date the civil surgeon signs the medical exam to submit to  USCIS.

Good afternoon. Someone else can please answer this question. I would really appreciate it. @sandranj

 

I have a question. In a few days I have the interview for adjustment of status (I-485) after an approved Vawa. I don't have all the passports, only the last two. And according to I-94 I also have only the last one. Will there be any inconvenience if I go to the interview without having all the passports and I-94?
