i just have many questions I needed to be answered as a new in vawa 

 

I filled out my vawa and sent today 

 

my abuser is a USA citizen 

i been abused mentally and emotionally ( proven by a Psychologist , and pics with a new lover . And texts ) 


And I been abused physically once ( I have pics is it enough) 

 And I been abused Financial ( proven by Transaction and text ) 

 
my questions are ‘ 


are those enough for a Successful case ? 

and does usics ask for more physical abused or once is enough? 
And the EAD how long does it take if I applied everything together and told by my lawyer under C9 ? 
 

Also I have joint taxes return both name leasing and bills since 2016 

and car insurance and bank account 

 

all has both name

it does but make sure that the application version was correct, i got a rejection after more than a month because of i-765 version was wrong.

Hello everyone, I was approved not so long and awaiting interview for form I485.

I moved from one state to another and recently update uscis that I moved using the change address online platform for only form I485.

Today I receive a message from the local office of my previous state that the new address has been updated in the system.

 

Below are my questions 

1) I notice the local office that send the email was my attorney local office and not the local office of where I previously reside, does that mean that all interview will been conducted at the attorney address Uscis local office or not?

 

2) changing my address online and with the confirmation from uscis, does that mean my file I485 will be transfer to the new state local office that I now reside or not ?

The fee is $435, however the following are exempt: Amerasians, VAWA self-petitioners, SIJ applicants, Iraqi/Afghan translators. So if you were filing I-360 for an EB-4 religious worker then yes the fee would be $435.

 

A NOID is basically a more serious RFE. They're issued in two situations:

1. After first review of the application the officer doesn't think you meet the statutory requirements (you didn't prove you were married or free to marry, you didn't prove the abuser was a USC/LPR, etc) and probably others as well.

2. After an RFE, sometimes if you don't overcome whatever standard of evidence they want, they'll give you a second chance to submit more documents and give you a NOID or a second RFE.

 

What should you do if you get a NOID? Treat it like a more serious RFE, give them what they're asking for. Best case scenario you'll overcome the officer's doubts and cruise to an approval. Worst case scenario (you don't overcome their doubts or just completely ignore the NOID) the application will get denied.

Thanks for clarifying! You're so knowledgeable in this. I guess my fear is that if it gets denied, do they tell you to voluntarily leave the country, deport you, sentence or give you the fine?

It's somewhat unlikely to end in removal proceedings after a visa petition denial (unless it's for criminal reasons). Voluntary departure can be granted by a judge during removal proceedings.

 

This is not a criminal matter, so you won't get sentenced or fined or anything of the like.

 

So what happens after a denial? You can always appeal or refile.
