That is fine to disagree, however anything purchased while married is considered marital debt, whether he is the co-signor or co-owner, and OP can discuss in divorce proceedings that she keeps the vehicle and the judge can order her to get a new loan.  The division of marital debt is handled in family court (who is responsible to pay what debt).

I'll write a shorter version of it here tho:

 

im german and we live in Germany because my husband was a uniformed service member. his orders is declared to 2021 (idk the month)

 

BUT he got medical seperated like 2 months ago, irregardless the embassy in Frankfurt responded to his email that they are still the right place to send the application at.

 

my and my 2 older kids i130 did he send around the same time he got seperated.

 

so since we went back to the provisional order I filed at the court, i don't know what to do.

 

in case some wonder why he sent the i130, he took pills and was normal during that time ( that was when I "frozen the provisional order" eventho official thats not a thing)

 

regarding to people I've asked and reaches out, I should file for VAWA. because spouses of service members can live abroad and still file for Vawa. But hes not anymore now. But his Orders we sent says 2021.

 

And some say I should just continue with our i130 and wait for the interview and all the forms I'll have to fill out.

 

I don't k ow what to do since we live in Germany and not America.

 

Also, I might should get a lawyer. Can someone recommend one?

 

You will need a lawyer to file overseas.  You can find a lawyer in Germany.  There are others here that are overseas and you can talk with them.

My experience was that once i left him, i feelth so relieved, and the first few days, it felt amazing, no fear, no anxiety about what may happen. One of my mistakes was that i didn't change my phone number and that i didn't file for a restraining order right away. Then again, my case was quite extensive, what i mean by that is that the abuse continued, and i had to file multiple restraining orders since he always violated them. He also hired a PI to find me and to continue to abuse and harassed me. Then again, then he also had like good moments, when he was saying how he was wrong and feel guilty for what he did and how sorry he is, but he never changed. He always went back to his mean and abusive behavior.  One advice that i def want you to follow if you can is. If something happens and he/she continue to abuse and harras, don't be afraid to file charges. I just recently filed charges, and that made hi stop. He went away for now. I didn't want to file charges because when you love someone, you always give them a chance, and you don't want to put them in jail or harm them, but just like a few police officers told me, and also the two judges and the states attorneys and the family center told me multiple times told me mine/your safety is important and if someone is trying to harm you that means that they don't care about you and /me/you have to do what you have to do to keep yourself safe even if it means that you have to press charges and to call the police not to be afraid. After i pressed final charges, he was warned by the judge that if he does it again, he will go to jail this time. So don't be afraid to protect yourself.

- Financial resources to survive.

- If possible, get a restraining order. 

- Change your phone number. 

- Change all you passwords. 

- Spend your 100 to file VAWA (if you haven't already). It is really not complicated if you just follow the steps. 

 

- Start learning meditation and self-care (if you don't practice already). 

- Read books that help your mind and soul to empower you. 

- Never look back and be proud of yourself. 

- Surround yourself with positive people and things.

1. Any idea what date range is being processed for i360 at vermont right now? My relative filed for i360 in September 2019. Can we expect a decision soon?

2. When i360 was filed, i485 was pending. During the filing of i360, it was requested to use the pending i485. What happens after i360 approval? How do we get to know if uscis is using the pending i485 or a new one has to be filed?

I believe the lasted approvals were April/2019 but still some from 2018 are pending.

After vawa is approved your I-485 enters to line to your local office to be scheduled for an interview. 

08/2017 - Married USC

09/2017 - Application for I-485, I-765, I-131

12/2017 - Approval  I-765, I-131

09/2018 Renewal application for I-765, I-131

04/2019 - I-485 interview scheduled 

04/2019 - I-485 denied, husband withdrew

05/2019 - Application for  I-360, I-485, I-765, I-131 

12/2019 EAD, AP approval

07/2020 EAD, AP renewal sent to Vermont

10/2020 EAD, AP Approval

11/2020 VAWA I-360 Approved (C31 produced)

01/2021 I-360 status changed to case approved

03/2021 - I-693 deficient notice from national benefit center
