Hi VJ community I will have my AOS interview next week for the  I 130 and I 485 submitted when I was with my wife but later was cancel by covid 19 my question is I applied to vawa on mach and I got the prima facie on April what I should do

go by my self to the interview and show the vawa application and ask for hold the AOS untill 360 final decision?

How should we answer if the officer asks questions about abuse or VAWA details? I honestly don’t think I can remember some details or even handle trying to think through all those details. It overwhelms me and my brain just gets like a big fog cloud. 
 

I know they shouldn’t ask but some still do...

Correct.Bring all the originals of your 130 485 applications with you in case the officer asks for them during the interview. Be very specific with your request for them to “put your 485 on hold, AND link your pending 485 with your 360”. It is very important they link both cases. Mine were not linked and this has delayed my 485 terribly.

You said it all..let the officer have a copy of your i360 NOA and prima facie..your i485 will be held in abeyance pending when a decision is reached on your i360.😊👍

You're right some do. Maybe they get a kick outta other people's pain..sadist..who knows? Do not dwell too much on this possibility..they may not ask..you can politely tell the officer you're uncomfortable re-living those horrific moments..but if you are able to answer simpler questions please do. I hope you are faced with a humane officer like mine..such an angel!😊🙏

Yeah I remember how smooth your interview went. I wish I get someone who knows that he/she is not supposed to ask those kinda questions and just allow me to finish this soul sucking process in peace.

 

I have another question... I had contacted my congressperson recently ( To check the status of my I485) and they got back to me saying USCIS is asking for more documentation to release info. This is what the congress employee received from USCIS. The last sentence kinda made me hesitate. Where it says “permitting the Member of congress and staff to be the new custodian of this information”. Do you guys see any odd point here or is it just me?

 

In addition to the Privacy waiver, Ms. xxx  would need to provide a waiver of confidentiality for protection under §1367. This waiver can be hand written and signed by Ms. Xxx and submitted to your office. The waiver should include written acknowledgement of § 1367 confidentiality protection, that the signatory is protected by §1367, that each of the applicants and beneficiaries related to the case are adults, and by each applicant and beneficiary that by signing the waiver and release they knowingly waive their §1367 confidentiality protection and are permitting the Member of congress and staff to be the new custodian of this information.”

Did you sign any privacy release document from your congressman? This is what they basically want...the signature perhaps wasn't convincing..not sure but they are requesting the privacy authorization so they can relay information to your congressman. You can also write and sign send to your congressman..that may settle it!💁

Yes Already sent a privacy release document with my initial request to the  congressman. I hand signed it. I’m just hesitant about the wording “new custodian of this information”. What does it mean? Like they will communicate through the congressman office with me from now on if I sign this?

Fancy term for same thing...they're referring to your congressman's office...in my case it was senator Kirsten Gillibrand's office..but in reality it was her staffs communicating with USCIS..I'm sure it's same with you too..so quit been perplexed and give them what they are requesting.💁

Haha yes ma’am 😀 the congressman employee told me they got this request from my local office. So my file seems like transferred from NBC to local office (after birth certificate RFE from NBC). But I still would like to get a few words for clarity from USCIS if it’s just an easy emailing through the congressman office.

While I don't think USCIS has the time for the back and forth you're suggesting, you may give it a go...I personally feel it's pretty clear what they're demanding...😊👍

Oh no, I will send them whatever they are asking. The congressman employee told me we can either close this request since the response came from my local office (indicating my file got transferred from NBC to local office) or I can send the extra documentation that USCIS asked for info release and see what they say about the status of my I485. Do you think this is unnecessary?

If there are other information you would like from USCIS, then you may proceed with their request..if all you wanted to know was the location of your file, well I guess you know where it's at now..you can close the request. Still it's up to you.😊

hello my friends!

I'm new to VJ and posted my first question already. I kinda got attacked and a very nice member of VJ gave me the link to this thread. 

maybe you guys got the time to look at my profile and read my post?

I'll write a shorter version of it here tho:

 

im german and we live in Germany because my husband was a uniformed service member. his orders is declared to 2021 (idk the month)

 

BUT he got medical seperated like 2 months ago, irregardless the embassy in Frankfurt responded to his email that they are still the right place to send the application at.

 

my and my 2 older kids i130 did he send around the same time he got seperated.

 

so since we went back to the provisional order I filed at the court, i don't know what to do.

 

in case some wonder why he sent the i130, he took pills and was normal during that time ( that was when I "frozen the provisional order" eventho official thats not a thing)

 

regarding to people I've asked and reaches out, I should file for VAWA. because spouses of service members can live abroad and still file for Vawa. But hes not anymore now. But his Orders we sent says 2021.

 

And some say I should just continue with our i130 and wait for the interview and all the forms I'll have to fill out.

 

I don't k ow what to do since we live in Germany and not America.

 

Also, I might should get a lawyer. Can someone recommend one?
