Reason 1 being that she can file for AOS together with you and get a work permit under category C9 in the meantime that way. Pending I-485 keeps one in period of authorized stay, meaning that even though you're probably without status right now you're still legally in US.

Reason 2 being that even if you cannot do AOS right now for some reason, a derivative is similarly eligible to get an EAD under category code C31 (they basically need a copy of their approval notice and copy of their birth certificate with translation if not in English, copy of some ID, file I-765 under category (c)(31)( ) with VSC and pay the fee).

 

VAWA deferred action was used a lot more prior to 2013 when the C31 category was instituted.

 

If you want to get her deferred action for some particular reason basically, take the I-360 approval notice, your supplemental grant of deferred action, her birth certificate with translation if not in English, some ID for her, write a letter requesting deferred action, and file I-765 under category (c)(14)( ) with the VSC.

The reason is that on the letter of approval of my i360 says I will get one for her and Sandranj also said I must get it. The one thing I am confused about is the what are the necessary forms I will submit to do that. And also she doesn't need i765 because she is only 11 y.o. It's basically deferred action and work permits in 2 year increments for people brought to US as children before June 15, 2007. I fall into this category. I only mentioned it because it is feasible that USCIS could approve your I-765 fairly quickly.

 

Also, how did you get the previous C9 EAD?

Yeah if you want to get deferred action for her you'd basically write to VSC and request it, together with the documents I listed. I'm just not 100% sure if they will take it without an I-765, you can try since well, trying without it is free. I know that for renewals of VAWA deferred action they basically want you to file I-765.

Contradictions without citations only make you look dumb.

Sorry, mine was rejected not because of fees it was the form version date. Yes both new (8/25/20 & 10/02/20) versions has  fee exemptions for i-765 renewals make sure to send the NOA's with payments for initial  i-485 & i-765.

$495.If you paid form I-485 and submitted the I-485 along  with form I-765  there is no fee to pay, but you must submit the I-485 receipt.

 

If you submitted  form I-765 without form I-485 to receive the first EAD then you have to pay the fee,  if you can't afford to pay the fees then submit form I-912.

 The derivative just  need to request deferred action in writing to the VSC, there is no need to submit form I-765.

You just need to request the deferred action in writing. Submit  copy of your I-360 approval, and a copy of your child's birth certificate with a respective translation as well.Your child is under 14 years of age then sign and mention that you are signing on her behalf.

Just submit the original RFE and submit what they are asking. You can add a cover letter.
