You won't get denied. They might let you in with an expired passport, however if you have any ID that's valid like an EAD or a driver license / state ID bring that instead as your proof of identity. Do bring the expired passport just in case they want to see entry stamps.

I did read the instructions again and they clearly say that c9 with AOS pending don't need to pay renewal fees

@Stillwinning!!!😊 Sandranj told me to get a deferred action for my daughter (remember my post the other day?) Do you know anyone who did the same thing? I've researched all over and all I can find is DACA (deferred action for Childhood arrivals) and my child doesn't seem to qualify coz she is only 11 y.o. DACA seems to apply for derivatives who are also getting EAD so they can work.

 

I have read some write ups also on VAWA derivatives and I understood that my daughter is a derivative for sure but I couldn't find anything that fits my daughter's age to get a deferred action. 

 

I don't know what forms to use if I should get one.

 

If there is anybody here who processed VAWA, got approved and with a derivative (minor child), please let me know what you did? Did you apply for deferred action? And what forms you used if you did?

Hey..USCIS is concerned about details..so do please furnish them with as much details as possible. They need closure that's the reason why they sent out the request in the first place..it is not an academic document..you will not be scored for it..so grammar or writing style etc is irrelevant. Straight to the point will get you approved faster! My tip!💁😊👍

I understand your confusion and worry dear..how about you wait for Sandra to tell you how to do that..or someone who has already gone through it..I haven't gone through it.💁

Hello Vawa folkers 

I am a vawa applicant and my work permit c09  and driver’s liceense will be expired after 90 days i will not be able to renew my work permit and i got my prima facie  , so there is any way to renew my drivers license without work permit ?!

What's the exact situation and why do you want deferred action for her? Like, VAWA deferred action isn't really used all that much these days for a few reasons.

Reason 1 being that she can file for AOS together with you and get a work permit under category C9 in the meantime that way. Pending I-485 keeps one in period of authorized stay, meaning that even though you're probably without status right now you're still legally in US.

Reason 2 being that even if you cannot do AOS right now for some reason, a derivative is similarly eligible to get an EAD under category code C31 (they basically need a copy of their approval notice and copy of their birth certificate with translation if not in English, copy of some ID, file I-765 under category (c)(31)( ) with VSC and pay the fee).

 

VAWA deferred action was used a lot more prior to 2013 when the C31 category was instituted.

 

If you want to get her deferred action for some particular reason basically, take the I-360 approval notice, your supplemental grant of deferred action, her birth certificate with translation if not in English, some ID for her, write a letter requesting deferred action, and file I-765 under category (c)(14)( ) with the VSC.

You need a document proving legal status unless you're in a state that allows undocumented immigrants to get driver licenses namely: HI, WA, OR, CA, NV, UT, CO, NM, IL, PA, NY, VT, CT, MD, NJ, DE or DC.

 

Definitely do file I-765 to renew that work permit. I managed to get a renewal on my DACA work permit in 87 days, was just approved today a month before expiration.

DACA (Deferred Action for Childhood Arrivals) is something completely unrelated to this thread. It's basically deferred action and work permits in 2 year increments for people brought to US as children before June 15, 2007. I fall into this category. I only mentioned it because it is feasible that USCIS could approve your I-765 fairly quickly.

 

Also, how did you get the previous C9 EAD?
