Hello everyone!!

 

i have been MIA for about a month now... I have moved apartments so been busy setting it up and working here and there and interviewing for a solid position. 
 

big congratulations to the recent approvals, 360, 485 and EADs!! Those like me waiting in line, may we be blessed with patience and grace 🙏🏼
 

I could not read everything I missed but the last few pages have a theme of people contemplating weather to file VAWA or not. I say if you have a case, DO IT. Abusers almost never never change... plz don’t play roulette with your life, we only get one. Don’t bet on the losing horse again ( don’t know if that is a saying) 

 

to the person who is worried about having another hoop to jump through if they go back to Canada/home county. i would say: 

If I were you and if I wanted to stay on the US long term and build a life here, I would not go back. If you are eligible for a work permit before 360 is approved, stay. Once you have a prima facia, you can enroll in college get your education or start working and building your career. 
on the other hand, you are not really interested in making the USA your primary base, you might as well go back where you have proper support and much better healthcare 😄 if the US thing works out, it can give you a lot of flexibility which you can use in the future... I think Canada allows dual citizenship. 
also, side note: American citizens  have to pay taxes on foreign earned income, so if you don’t plan on making USA your primary base long term... consider all angles. Tax, work-life, career etc  good luck !

I have arrest history.

-why my case dismissed , they not accept this dismissed notice , I already told her that is dismissed notice , but she still said maybe need more document . Even I told her judge already sign agreement expunction this record .

- order to expunction 

due to I have one arrested but I didn’t have go to court and then dismissed.

You will be approved for sure. Could you share with us your timeline?.

What's annoying is that I had an approved I-130 previously, one that my ex and I were interviewed about, RFE'd, and finally approved.

 

In my RFE response I basically gave them everything extra I could. Couldn't get my tax transcripts from the IRS because of COVID so I submitted secondary evidence like a print out from turbotax that the returns were filed via them matching the numbers on the previously submitted tax return and a cover page from a NY tax return check (which should prove that we at very least filed our state taxes jointly), various gift receipts (covering a few years before and after we tied the knot), ring receipts, bank statements with a lot of items distinguished, I-130 RFE showing that USCIS already demanded more, got it, and thought the marriage was legitimate enough previously, our college transcripts showing classes we took together (we met at college and both majored in Computer Science). I also pointed them to the previously filed I-130 and associated documents which contained among other things a letter from our landlord that we're renting that place together. In the cover letter I made a legal argument based around 8 CRF 245.1 (c)(8)(v) that the I-360 should be exempt from the heightened evidence standard since an application based upon the same marriage was already approved previously, but I still nonetheless explicitly requested an exemption under INA 245(e)(3) just in case. I honestly wouldn't be surprised if I caused the VSC to get an advisory opinion from the AAO by doing that or have them fetch the I-130 and related things from the NVC which is why this is taking so long.

Hello kind people! Today I received my formal approval notice after I already received my c31 EAD a month ago. I do have a question. Is the wording about deferred action normal to the approval?

 

 

Also, my child (minor) is a derivative of my i360 and it said something I have to apply for her separately for deferred action. I am not familiar with this.

 

Please see attached pictures and enlighten me. Thank you all as always.

Hi, the wording so far is not unusual..same was written on my notice save for the derivative part...but from what I deduce(not 100% certain) just a deduction based on the wordings on the notice, the deferred action covers you alone..not sure why..but this doesn't mean your child can not adjust status. You may request this document for your child like the notice suggests or you can let it slide until you get your greencard. Hopefully Sandra elaborates on it.👍

That's why I concluded as well to get her a deferred action but I was thinking if I really do have to since she already has a pending i485 and did biometrics as well long before. @sandranj I hope you can give enlightenment. Thank you.

Hello guys, I am writing to you this guys because yesterday my car got stolen, and my EAD card was inside as well as my passport as I was out of town. do you guys have any idea of how the replacement is processed and what are the documents I need to send USCIS Vermont centre.

last question if I am applying for employment do I need my work authorization or I can give them just my social security number. 

Thank you guys in advance, trying to stay positive about this.

If she has a pending i485, then she certainly doesn't need a deferred action document. Case closed. You can relax now.😊👍

Don't lose hope, and I'm sorry. I did not want to say to scare you or make you worried. Your psychologist may have not copied, and could've written a good report based on the facts you shared with her/him. This might be of concern if your psychologist is not an immigration psychologist and is a very lazy one.
