Hello everyone! :)

 

Hope you have been doing well while I was away from thinking about immigration for a month....although I have a quick question:

 

If I filed on Sept 25th and received the receipt notice the following week but no prima facie yet, should I be worried? Its been almost 2 months.

It can take some time to get it or you may not get one at all. My case took about 18 months for approval and I never got PF.

08/2017 - Married USC

09/2017 - Application for I-485, I-765, I-131

12/2017 - Approval  I-765, I-131

09/2018 Renewal application for I-765, I-131

04/2019 - I-485 interview scheduled 

04/2019 - I-485 denied, husband withdrew

05/2019 - Application for  I-360, I-485, I-765, I-131 

12/2019 EAD, AP approval

07/2020 EAD, AP renewal sent to Vermont

10/2020 EAD, AP Approval

11/2020 VAWA I-360 Approved (C31 produced)

01/2021 I-360 status changed to case approved

03/2021 - I-693 deficient notice from national benefit center

Hi Blunt, thanks for the encouragement. I have actually been working and keeping busy. I however have an emergency at the moment, and would like to go home by December or January, that's why the urgency came up. I started this process Oct 2016. So I've been patient, I really need to go sort out some urgent issues at home. I only found out about AP in August and have applied for my combo card.

No, you don’t have to worry,  there’re a lot of people here who got their I-360 approved without Prima Facie

That’s why you need to go to the court before they arrest you, usually they will not come looking for you, unless  they pulled you over by driving mistakes like fail to stop for stop sign or red light, things like that, and if they check your ID , they gonna see everything, they will then arrest you for arrest warrant, they gonna lock you up for one day and you gonna see a judge, the judge will give another court date or maybe finish your case the same day, but you can do what’s best for you. But you can also go to court in your current state, it will be easier for you.

That's what happened for @Jacobamanda63

You are right. I thought we only need to summit criminal records from the state where you live over 3 years. IN is the first state that I lived and it was less than 3 years, so I thought I don't need to get no criminal records from there, also my immigration attorney did not recommended to me do so too. 

It was big mistake that I did not checked it before USCIS requested evidences from me. I don't know how it goes since it has been so many years ago and it already court ordered.

I thought read somewhere and it says only needs police report from where you lived over 3 years. I got the wrong information about this then made things very difficult now.

You must have your case dismissed in order to have your green card approved. Your case MUST BE dismissed ON THE MERITS,otherwise your green card won’t be approved.

 

Make sure that your criminal attorney knows that  you NEED  the  dismissal ON THE MERITS.I am not going to explain here about criminal law because this thread is for Vawa cases.

 

 

Thank you very much Sandranj, I am looking for a good criminal attorney but not find one yet.  I will keep posted here about my case.
