You can make a post in that subforum  if you have a lot of questions that are not related to the VAWA 3yr rule for being eligible.

Hey you can get that info on the USCIS site..but amongst other docs....Greencard, state issued i.d card, travel records, tax docs for last 3yrs..proof of current marital status and termination of prior marriages, proof of official name changes if any..of course the form(N-400) and fees.😊👍

Every court is different but generally most courts only consider marital assets and debts that were during the marriage. What you do after separating is usually not considered as 'joint'. Lets say you guys separated and he took out a loan for 10k. The 10K loan should not be split between you. That was his loan, he did it after you guys separated, you have nothing to do with it. So you were able to save for school. Thats great! I hope you looked into FASFA and what kind of financial aid you can get (prima facie will make you eligible). I dont believe there is a Judge anywhere that would declare the savings you accumulated after separation should be considered joint marital assets. You can give your attny a paper trail of the money- showing how you deposited every week for the purposes of saving for school. As long as it all makes sense and can be explained you shouldnt have any issue. If you were to tell me that you guys had a joint account and there was a withdrawal from it for 3600$ right before you separated and you currently have a savings account with 3600$ in it- well then yeah the Judge may say you took $ from the marital assets and would determine what happens to the 3600 that is in your sole account. But thats not what happened. You can show where the money came from in your sole savings account and how it has nothing to do with being related to the marriage. 

 

 

Thank you so much. I must admit that I’m still nervous about this whole thing. I thought everything would be 50/50 because we are still married though separated over a year now.

 

I’ve been looking into FAFSA. My prima facie is going to expire in Nov 2020 though and I’m trying to go back to school next Fall.

The USCIS site doesnt include what kind of supporting documentation is needed for VAWA cases

You have to petition the court to have them legally evicted from your apartment.

Required supporting evidence

In addition to the completed Form N-400, you must also submit the following documents as supporting evidence with your Application for Naturalization: 

  • Two identical recent passport-style photos (only applicants for who live abroad)

  • A copy of the front and back of your Form I-551 (Permanent Resident Card)

  • A copy of a document that demonstrates your current legal marital status, such as a marriage certificate, a certificate of divorce, an annulment decree or a death certificate of a former spouse

  • For members of the Armed Forces and their spouses, Form N-426 (Request for Certification of Military or Naval Service). If you are currently serving, Form N-426 should be certified; if your service has ended, you can provide an uncertified Form N-426.

  • For members of the Armed Forces, evidence of military service, such as DD Form 214 (Certificate of Release or Discharge from Active Duty) for all of your periods of service. 

  • For active duty service members, a copy of official military orders should be provided

  • For spouses of military personnel, you must meet additional eligibility requirements, which you can find on the Military page of the USCIS website

In addition to the documents above, which should be submitted with your Form N-400, you will also need to bring the following documents with you to your naturalization interview: 

  • Your original permanent resident card

  • A valid state-issued identification, such as a driver’s license or a non-driver I.D.

  • Valid and/or expired passports

  • Travel documents that have been issued by USCIS

  • Proof your current legal marital status, such as your original marriage certificate, divorce decree, annulment decree, death certificate (if your spouse has passed away) and any other records that confirm the history of your marital status and the validity of your current marriage

  • Evidence that your spouse’s previous marriage has been terminated (if applicable)

  • Any documents that serve as evidence of a legal name change

Thank you for understanding, my abuse is not in jail, and he used a PI to find where i live and was breaching the restraining order, but since my last court day where he was warned by the judge, he stopped but still trying to call and email me and harasses me.

It is what it is i hope that everything will be ok and i will be able to finaly have a normal life.

Keep your counselor...  I had my therapist because I needed to work on me and how although I am fragile, I can recover and function through the trauma.  I did have a psychologist to do the psych eval. and that is all he did.  The psych eval took one month to write and I had about 4 weekly visits.  

I was able to find a psychologist over this weekend, and she said the process is a psych test, one 2-3 hour sessions where I tell the story of my life, and then she'll write the report. That's it.She asked about my personal declaration, but as advised in earlier threads, I should never share it with the psychologist. She's involved with non profits and seems like she's done hundreds of evaluations.

Ideally you want someone who knows immigration. The evaluation needs to be written a certain way with specific terms and contents. A general psych Dr may be qualified to write it but will not know exactly what needs to be written. So you really want someone who knows immigration and has written evals like this before. Typically for the evaluation you have 5-7 sessions and then they write the report. They are not 'long term' therapy- you should continue your therapy with a local provider in addition to the evaluation process. 

Thanks Villanelle! What you wrote makes sense. One concern I have is finances, but hopefully I can manage.
