I added everything else I could with both of our names or with common address, pointed them back to evidence previously submitted, pointed them to a previously submitted and approved I-130 and some evidence there like a letter from the landlord, basically said their arguments were complete BS in slightly more polite words ("I disagree with the assertion that..."). I wasn't able to get our tax transcripts because IRS was closed due to Corona so I gave them what I had - the cover page from a NYS tax return check, print out from Turbotax, complete bank statements with the tax returns distinguished, with an explanation in the letter that IRS is closed and I hope that this will be enough in light of the circumstances.

 

Basically everything that I submitted was as follows:

 

  • Initial application:
    • I-360
    • Self-affidavit / cover letter
    • Copy of ex's US passport
    • Copy of I-130 approval notice
    • Affidavits from friends and family including ex's father (originally written for the I-130)
    • Marriage certificate
    • Copy of photographs
    • Copies of our driver licenses
    • Copy of joint tax return (unsigned, got it from turbotax)
    • A few months of joint bank statements showing that I was the only one working and that my ex stole money from me
  • RFE
    • Another cover letter
    • Complete bank statements covering the period we lived together with the following items distinguished:
      • Rent payments
      • Bill payments
      • My wages
      • Transfers to or from my ex
      • Transfers from ex's father
      • Payments for ex's student loans
      • Tax return payments
    • Cover page from NYS tax return check
    • Receipts for wedding and engagement rings
    • Receipts for various gifts
    • Prior I-130 RFE (similarly they questioned the bona fides of the marriage)
    • Request for a bona fide marriage exemption
    • Copy of receipt notice for a FOIA I filed for my I-130, which was unlikely to be processed by the time the RFE is due
    • College transcripts showing classes we had together
    • Print out from Turbotax showing that the taxes were filed, processed, and issued, matching the amounts on the previously submitted tax returns

Contradictions without citations only make you look dumb.

Ohh thanks so much ..as for me I didn’t have social security all through the time we married so am limited to many things ..I wrote that out in my self affidavit again ..so I hope I get positive news ..

Infopass question.. 

I called USCIS to schedule an infopass and the lady said someone from uscis is going to call me back in 8 business days to schedule it. Is that normal? 

08/2017 - Married USC

09/2017 - Application for I-485, I-765, I-131

12/2017 - Approval  I-765, I-131

09/2018 Renewal application for I-765, I-131

04/2019 - I-485 interview scheduled 

04/2019 - I-485 denied, husband withdrew

05/2019 - Application for  I-360, I-485, I-765, I-131 

12/2019 EAD, AP approval

07/2020 EAD, AP renewal sent to Vermont

10/2020 EAD, AP Approval

11/2020 VAWA I-360 Approved (C31 produced)

01/2021 I-360 status changed to case approved

03/2021 - I-693 deficient notice from national benefit center

🙏🏼 Thank you for this!! I’m a Dec2019 filer, I never got a prima facia and I’ve been so worried so this right here gives me hope.

My EAD under my I-360 case is showing as delivered to my old address but the owner there says they didn’t receive anything. So I’m trying to set up an infopass to make sure they can update my address(already mailed the change of address 2 time to Vermont). But they called me back and said there are no infopasses available at my field office, told me to try calling again next week. :(

oh... that is a headache. How long ago did  you move?

I moved about 3 moths ago as well, updated my address with AR 11, however, I think mine will likely go to my lawyer... hope that is where they send it, just easier that way.

- Where to send the I-485 and what to attach to the form.

- Do I need to still attach evidences to prove Bonafide Marriage?

- Can I file a waver for the I-485 fee?

Yes submit what you have showing a bonafide marriage, submit a  copy of the I-360 receipt, a copy of your marriage certificate, birth certificate, copy of the divorce decree(If any) ,  copy of your I-94 , a copy of you spouse's birth certificate and 2 passport-type photos

 Submit form I-912 if you can't pay the USCIS fee.

 

You can file form I-765 if you need to work, form I-131 for advance parole, and G1145.

Nope, your abuse  can't  access anything related to your VAWA case, and his attorney can't request either.

I moved in June. I didn’t use a lawyer so everything is based on my address. Luckily I just heard back from my congress woman and she will reach out to them later this week to update my address and request a new card to be sent to me! 🙏🏻🙏🏻
