Have you lived in the same county? If you lived in different places in the last 3 years (I believe it’s 3, could be more) you would need police clearance from the other counties too.

If you have someone who can also write a an affidavit saying that you hare a person of good character it can help too but not necessary. 

08/2017 - Married USC

09/2017 - Application for I-485, I-765, I-131

12/2017 - Approval  I-765, I-131

09/2018 Renewal application for I-765, I-131

04/2019 - I-485 interview scheduled 

04/2019 - I-485 denied, husband withdrew

05/2019 - Application for  I-360, I-485, I-765, I-131 

12/2019 EAD, AP approval

07/2020 EAD, AP renewal sent to Vermont

10/2020 EAD, AP Approval

11/2020 VAWA I-360 Approved (C31 produced)

01/2021 I-360 status changed to case approved

03/2021 - I-693 deficient notice from national benefit center

I have been a silent reader here for about 3 years. With the grace of God and helps from here, my I-360 was approved. I was waiting on I-485 approval as I thought my I-485 was held in abeyance. Unfortunately, after waiting for three years, USCIS told me the previous I-485 filed by my abusive spouse had been denied and was not held in abeyance. 😥. I wouldn't know this because USCIS kept renewing my C09 for 3 years. (Sad)!!!! 

 

Now I have to file a new I-485. Please @Sandraj or whoever can help me. I need info on:

- Where to send the I-485 and what to attach to the form.

- Do I need to still attach evidences to prove Bonafide Marriage?

- Can I file a waver for the I-485 fee?

- What's the timeline I am in for after filing?

You complete the form and include a copy of your VAWA approval notice.  You do not need to provide proof of Bonafide Marriage, but you still need to provide the other required information.  Also, you do not need to submit I-864, you do not need it anymore.  You do not have to print your I-94, it is no longer needed because of VAWA approval.   

 

You will need - 2 passport pictures, Copy of Passport, Copy of Birth Certificate.

 

You can file a fee waiver, but if you were employed you will have to submit proof that you cannot pay the fee.

When you received the previous reports, you only submitted your married name???  When you request a police clearance, it asks for other names.  This includes your maiden name, and middle name to be included.  I would include the birthday.  They found it somehow, even if it an error, you can disprove it with police clearance.  

 

Don't forget this also includes resubmitting the police clearance from your home country.

You should probably contact the field office or service center that was supposed to hold it to see what's going on because it's weird that they kept renewing your C9 EADs. It could be a mismatch between what the system says and what's going on for real.

 

Anyways regarding filing a new I-485 if you'll need to:

 

You send it to:

USCIS - Vermont Service Center

Attn: CRU

75 Lower Welden Street

St. Albans, VT 05479-0001

 

You do not have to attach evidence of bona fides, abuse, or anything of the sort.

You do have to attach the same documents as any other applicant for AOS:

  • Copy of I-360 approval notice
  • Copy of birth certificate with translation if not in English
  • Copy of Government issued ID with photograph like: Passport, Driver's License, State ID, EAD, etc. Preferably valid but if it's expired and that's the only thing you have send that in.
  • Copy of evidence of admission or parole into US: I-94, Passport with visa and admission stamp (this is optional)
  • Form I-693, Medical Examination and Vaccination Record (you can also not send it in and bring it to the interview later)
  • If you were ever arrested/charged/convicted for any crime, attach the court or police records showing the final disposition of the case (i.e. no charges filed, charges dismissed, found not guilty, found guilty)

You do not have to and should not include either form I-864 or I-944.

 

Yes you can include form I-912 with your application(s) to get a fee waiver. Note that subsequent I-765/I-131s renewals you'll either need to pay for, or get another waiver for them.

 

Current rough timeline is about 12-18 months depending on your field office.

Oh My Goodness! this a well detailed and much needed reply. Thanks a lot @Demise. I am looking to file a parole with this I-485. However, I just got an I765 approval 6 months ago. please do I need to pay for the I-131?

No. Just include it with the AOS package. When I said subsequent I meant that all will come after this one. So the I-765 and I-131 you'll file with the new I-485 will be covered by the same fee waiver.

If your I-485 will take a while and you'll need to renew your EAD and Advance Parole then those I-765/I-131s you'll need to either pay for or attach another fee waiver for.

One last question for @Demise. Does a fee waiver work for an employed applicant. I am just scared of having my package returned. Thanks for all you do🙏

I mean you need to either be a recipient of federal benefits, make less than 150% of the US Poverty line, or have some compelling circumstances to seek it (like a lot of medical debt).

 

I would definitely write to the office had had your I-485 and ask them what's going on with it first though.

Thanks. I did ask the National Immigrant Justice Centre as well as The Congress to help me on this after everything was silent for years. They were the once who came back with the findings that my I-485 has been denied. 

 I think it will be hard to get a waiver
