Not everyone receives prima facie. There are plenty of people who don’t receive it and still get approved. If EAD was correctly filed under C09, then you should receive it in 4-8 months. Is this your initial or renewal? If it’s a renewal then you can use the receipt notice as your form of extension until you receive your card. It gives you 180 days extension I believe. If it’s your first EAD, then you may request to expedite after 90 days by providing hardship. I’ve heard it’s not a guarantee that your application will be expedited, so you can do nothing but wait and be patient. I pray you get your EAD within that timeframe and that you receive a Prima Facie.

I already received a prima facie two weeks ago.
It’s my first one for C09 category. I’m currently working on my EAD through OPT category (student EAD), which expires this coming spring.
I filed for C09 EAD back in July, 2020. Do you think I’ll get it before my current EAD expires?

Congratulations on the Prima Facie. I received my first EAD around 5 months, so you should be fine. I would expect you to receive something around December or January at the latest. Did you submit everything to Vermont office? What exactly did you file in July, if you don’t mind me asking. Did you file 485-360-765 all together? With C09 EAD and C31 on 360 upon approval?

No, I filed i485, i765 (C09) and i131 in July, 2019 to NBC. i765 and i131 never got approved.

Then filed i360, second i765 (C09) and second i131 to VSC.
In September I received Transfer notices that i485, first i765 and first i131 were successfully transferred from NBC to VSC.

Currently I have i360, i485, two i765 (both C09) and two i131 pending at VSC

Okay, you should be fine. I hopefully for you. I received mine relatively quickly, so hopefully you will too.

How long does it take to get C09 EAD after receiving prima facie?

Prima Facie has nothing to do with your EAD application, so there is no way to answer this question.

Congrats! I am at 18 full months right now, nothing yet for me.
But I think it depends on country of origin, because they are allowed to issue an X amount of GC to each nationality every year, so I think some go faster then others at first stage, but then at field offices they sit in the same line. Does that sounds right guys ?

I would talk to your attorney if you have one. I believe they can call the VAwA unit line, but you can’t. If USCIS have your address, then you should receive a notice by mail. It doesn’t always update online ( it didn’t in my case). I’m not sure if there’s any other way to find out. If you call in, they won’t share any information because it’s a VAWA case.

I know that they wont tell me anything even when the petitioner is calling, and they will only give out information to the lawyer on file. The reason why i'm asking is that my lawyer is not having my best intentions and is not doing here job, she messed up a few times with my EAD, and also when i asked her to follow up on my case because i will lose my job she never informed me about the updates on my case and told me that they never received any updates regarding my recently approved EAD and even when they checked with USCIS they told them that is it in process and the truth was that at the time that they reached out or when they say that they reached out my EAD was approved but they never received the update which is strange?  Can someone please advice

I’m so sorry that you’re having all these issues with your attorney. I hope someone else has better insight or more information for you. I know you’ll come out victorious in the end.

Thank you @DmytriiD I think you are right but I also think if your application is well put together the person who is handling your file will not have a hard time Adjudicating it and my lawyer did a great job for $ 0.00 respect goes out the the New Heaven legal assistant attorney (Diana Blank) and I didn’t get an RFE but 2 prima facie god bless you all more approvals are coming

Hello everyone,

I left my husband over 4years ago, but I've not been able to divorce him cause he relocated to a different city. I don't know where he is and I'm also keeping a low profile (I don't post on Social media). Does anyone know if this might be a problem when I'm sent interview notice? Will it affect me getting the GC?

For those who are divorced, how did you file?

Not at all, is not going to affect you, you are a vawa applicant, and they are expecting you alone to show up at the interview.

Did you have C09 EAD all this time? If yes, how long did you wait for initial EAD

No, it will not affect your greencard approval.

I also left almost 4 years ago when VAWA got approved and moved out of state.  Not divorced yet and not even thinking about it until am done with this journey.

That's a whole different journey and I don't want to mix it with this one.

@ValeryK no I just file the I-360 alone and waited 17 months for it to get approved so now I can work on the books 📖
