Hello all, this is a valuable forum, better info than what many lawyers can provide. I hope to both contribute and learn in this forum.

My details: 

filed I-360 Nov 12 2019

Prima facie  issued January 10, 2020

filed I485, I765 and I131 packet on february 24, 2020 (used c31 on EAD application, stupid lawyer)

Got EAD approved in mid june 2020 after new i765 filed with C9 category in April (thanks to all the info on this forum)

(had contacted senator in April and requested emergency EAD from USCIS through senator for humanitarian reasons)

Received I-485 transfer notice on September 30, 2020 ( transferred from VSC to NBC) . Notice stated this transfer was in order to speed up processing. 

Received AOS (I485) and I765 biometrics notice on November 2, 2020; biometrics done on November 20, 2020. 

My I-360 case status has no changes on it, Still states "case was received" as of today. 

Does this mean the VAWA I360 is approved and case status is just not updated online? What kind of processing do they need to do with I485 before I360 is approved?  

Hope someone can throw light on this based on their experience. 

 

I would also be happy to answer questions of other people on this long journey, in as far as I understand the process.

On H1b status since 2014, H1b 6 years expired in May 2020. Out of status / Period of authorized stay since then. 

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

You do not have to worry about anything! You have the report...and are attending therapy..that's great! You are alright. Absolutely nothing to fret about! Remember cindy told her story? Approved without psychological evaluation? This might be rare but it happened! I don't encourage anyone to overlook it as it's an important part of the petition..but in this particular journey, I've seen folks who have little approved, and those with a lot turned down! Just do your best and leave the rest for the Almighty!!!🙏😊👍

Be aware that vawa takes about 18-24months to be adjudicated! Your i485 regardless of where it was transferred to will only be attended to after a decision is reached on your i360! If your i360 is approved, it will be updated in the case status online. From your narrative, looks like it's very much still pending! I wish you all the best..patience helps a great deal here.👍

Hello all,

 

I applied for new i765 combo card in Sept. I got my receipt notice. My case was updated yesterday to show fingerprints were taken. In my experience with c31, my case is usually approved right after my case is adjusted with above status. 

 

My question is, is it possible they are about to approve my combo card? Or it's the first step for c9 category. Any useful info will ease my tension. 

 

Ps: I didn't know i could apply for a combo card until I started reading here in July. I'm paying my lawyer a lot, but no useful info. Thanks to everyone on this site

It's a standard update to reflect that your fingerprint in the system is being used. It's definitely in process..moving along..usually takes anywhere from 4-7 months to be ready!👍

First of all, welcome!

I'm sure many would like to know what humanitarian reasons you used to speed your EAD and did your lawyer do this for you or did you do this by yourself?

 

No processing for 485 will happen until 360 is approved. Since your 485 has already been transferred to NBC, yes, I see why you would think 360 has been approved but someone forgot to update. That's how it seems to me too. Just wait see, Hopefully that's the case.

Wow! 4-7 months? I really hope my GC is out before then. Cause i360 was approved Sept 2018. The wait is exhausting.

sorry, forgot to mention, I do have a lawyer in my case, but I did all of this research myself. The lawyer filed under C31 initially, that's what delayed the EAD in the first place. Please google "expedite criteria uscis" to see the reasons that USCIS might consider to expedite any petition that doesn't have premium processing. I framed my EAD expedite request based on the expedite criteria and sent it through senator's office.

At the same time if you feel things are going badly you can ask for a supervisor, but that to me, seems like it could cause more delays. Since they might reschedule your appointment.

 

Most IO don't go there. Let's pray you get one of those.

I have my i485 interview in 3 weeks. My question is can I take a relative , my daughter , to help me translate ? 

 Or will they not allow it. I tried to find information online and all I found was that it depends on the officer. Does anyone have any experience or have an idea ? Thanks

I wouldn't do it if I were you. Quote from an article:

 

The guidelines also give USCIS the power to disqualify someone from serving as interpreter, if the person is not sufficiently fluent in both English and in the interviewee’s language and able to interpret competently, impartially, and without bias. This means that, for example, a family member with a personal interest in the outcome of the case might not be allowed to serve as interpreter. In fact, USCIS explicitly says within its guidelines that “family members will generally be disfavored as interpreters if there is another qualified interpreter available to the customer.”

Thats what I found as well online. I hope some people here know of they were able to or not.
