Good evening everyone, my girlfriend is a green card holder. She has been in USA for almost 9years and we are planning to get married soon, can we file for my documents after marriage and hope been a green card holder will not affect anything. Your kind response will be duely appreciated. Thanks

Once you are married you can file the petition as a spouse of a US Citizen. I see in your profile you have pending adjustment of status, I will assume this was added in error because you can not adjust status.

What are you trying to file? From your history it seems you tried to adjust status through marriage last year, were denied, and are now trying again with someone else? This someone else is not even a US citizen?

Yes your wife as a Green Card Holder can petition you to immigrate.

Your green card spouse can file for you after you marry.


You're going to have an uphill battle with USCIS since you posted 10 months ago that you got a NOID on your I-130 with your wife.  Now you planning to marry a green card holder.   Your situation looks live marrying for a green card.

Yes, that's true. My first marriage was denied and now my girlfriend is a green card holder and we getting married soon

No, it wasn't added in error. The adjustment of status was denied and a divorce took place. Right now, I have a girlfriend that's a green card holder

Wait. You divorced after your adjustment  was denied? And before anyone can blink you have a new fiancée?  Where are you now? Has there been any overstay in the US?

Was there a finding of a sham marriage with the previous spouse? Or was it just that you failed to demonstrate a bona fide marriage?

Because if it was the former (or even if they conclude so later...), then there is a bar on any other spousal case.

And certainly, divorcing after an AOS denial isn’t a good look.

And unless he is on another valid visa there would have been overstay which makes it impossible to adjust through a LPR spouse. Hence my previous question. Potentially more than just one hurdle here.

Yup, very true.

I was just pointing out that if there was a finding of a sham marriage, then there is no way any spousal case can ever work unless he can overcome that prior finding first.

I'm sure you can see how this looks like sheer desperation to get to the United States.  If the first one was denied because they suspected fraud, you'll have the same problem with this.

Well, there was infidelity in the previous marriage and my ex-wife got pregnant outside the marriage. Am saying she got pregnant for another guy and even before that, she has been coming home lately telling me she is in her sister's place and finally got pregnant for someone else.
