Include any originals in i-751?

Hello,

 

I have two questions. When we applied for a US Passport for our daughter, we had to include an original birth certificate. Is the same true for i-751? We will include the birth certificate of our daughter, who was born early this year. We are wondering if it should be original. 

 

Another question is, when we filed for AOS my wife was an overstay so it was a bit complicated and we had a legal representative and we got approved and her status adjusted successfully. Now, we will file to remove the conditions from her green card. Should we also get a legal representative or lawyer for this? I feel like the i-751 is not nearly as complicated and we can handle it on our own and save some money. We have good documentation of our loving marriage and had our firstborn daughter this year. Any advice appreciated.

Timeline

Obtaining a passport and applying for immigration benefits are two separate things. Do not send any originals. Send an unaltered photocopy. If your wife has questions she can ask and look around this site- lawyer not needed. Don’t forget that it is her application not yours.

You don't need a lawyer, My wife was a 24 year overstay. All that was taken care of at adjustment of status. I hired a lawyer for the adjustment of status and all he did was fill out the forms. He wanted more money to attend interview and I told him to stay home, I got this.

On the Birth Certificate I think a copy would suffice, I've only sent copies. If they need a original they will ask. I've read somewhere that you don't send originals as you wont get them back.

Passports and immigration benefits are two completely separate things. uUSCIS says very clearly in their instruction packets to send photocopies ONLY. You will not get originals back if you send them to USCIS.

 

No lawyer needed. Overstay is forgiven for spouses of US citizens. Her AoS was approved; therefore, it's no longer an issue.
