AOS filing with an other visa (VWP, B2, J-1; F-1 etc)

Hi,

I'm just feeling like putting together things that we found out about filling for the form and the rest of the process when the foreign spouse came in the US under a different visa than the fiancé or marriage one. And some of the example forms were filled for K1 or K3

So far here are a few things.

#2 Filling the forms:

*On the I-485, Part 2, Application type: check the "a" box (an immigrant petition giving me an immediately available immigrant visa...)

*Yes you need a G-325a for the USC and for the spouse.

*We have to add proof of our bonafide relationship to the application (as stated in the guides)

#3 The medical exam

*If you can get the vaccination record from your home country do so. It will save you a lot of money.

*If you don't have them, see if you can have the missing one at a local doctor or the county Health Department. Compare the prices.

*I found out that I can do the TB test at the local Health Department. Mine was positive (due to BCG vaccination as a child) and they told me that they would do the chest X-ray for free since I've been in the US for less than 2 years :) (I will confirm the info on monday).

That's all I can think of for the moment.

For #2, I would add that for the I-130 you need G325A for the US Citizen and the foreign spouse, and for the I-485 you need another G325A for the foreign spouse.

married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

Yes, there should be three. The requirements for forms cannot be aggregated, here are the requirements:

I-130: 2 G325-As

I-485: 1 G325-A

Therefore the total number is 3 if you are filing I-130 concurrently with I-485. You need the treat the requirements for each form separately, because they may not all be processed by the same person.

My guess however would be that this will not cause you any severe issues.

The G 325 A isn't in the instruction requirements for the AOS for the USC. Lots of people submit it anyway.

I did and "No harm, no foul".

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Something to keep in mind as well- when you fill out and print the G-325A, 4 copies are automatically generated. All 4 copies must be submitted for each instance it is requested. So, using Dr_LHA's example above:

I-130: 4 copies of G-325A for non-USC ; 4 copies of G-325A for USC

I-485: 4 copies of G-325A for non-USC

I was confused when 4 copies printed out, so I thought I'd let you know. They want all 4!!

It's mentionned on the I-130, page 2 of the instructions:

4) A completed and signed Form G-325A, BiographicInformation, for you and a Form G-325A for yourhusband or wife. Except for your name and signatureyou do not have to repeat on the Form G-325A theinformation given on your Form I-130 petition.

Yes, and you were incorrect. The requirements for each form need to be treated seperately. You can't rationalise it yourself, because who knows how these forms get processed at USCIS. You should give them everything they ask for, i.e. 3 G325-As. Really its just a case of printing out another copy, is it really worth the risk to not do this for so little effort?
