Hello my fiance and I are both planning to file for k1 soon, however, I am concerned about the income requirement. I was not working as much in the beginning of the year so I should be at around $24,500 after taxes by the end of December. I understand that I am very close to the minimal requirement and am concerned that the application or adjustment of status will be rejected. We are both young and originally met when I was backpacking Europe and she has come back to the United States to visit so our relationship is as legit as it gets. The only red flag is the income and I am worried that I will need to get a better job right now to show proof that I can provide for her. I am currently making $16 an hour working full time and am living with my dad rent free. We both plan on going to nursing school when she gets here. Any insight? Thanks

Your options are to get a better job or a second job OR obtain a joint sponsor. You shouldn't be worried about getting another job (or better job) you have time before you need to submit the affidavit of support. Please add the country of the intending immigrant to your profile as some consulates are more strict than others and you can get more accurate advice.

$16/hour * 40 hr/week * 52 week/year = $33,280/year. That would be your current income, assuming "full time" is 40 hours a week and is paid every week of the year.

What you made earlier in the year isn't your current income. For instance, if you were making $50k/year earlier and were laid off, your current income would be $0 despite any prior earnings.

 

That said, schooling is expensive and many financial programs won't be available to her for some time (and she won't be able to work at all for several months either). Schools may or may not treat her as a resident until she has either a green card or has lived there at least x months...so that may mean international student rates (or at least non-resident rates).

Also keep in mind healthcare insurance costs.

Better option

 

1 marry and apply for CR1 so she can work and study when she comes here/ less expensive even with the airfare to marry

(CNN) California will provide free tuition for two years of community college to first-time, full-time California students. California governor Gavin Newsom signed legislation to increase the 2019-2020 state budget to $42.6 million.

 

she can work immediately and to be considered for free college ,  she may need a degree from California so even if she is graduated, it is worth it ,  to study and pass GED (that's the way it is in TN ,  so check it out,  she may only need to be California resident)
