I met my (ex) in 2014  She was on a student visa, We married in 2015 , She received her Conditional green card around that time we started to have many difference maybe in culture. She received her permanent card 6 months ago and this month we finally decided that we should be better off if we go different ways. I been talking this person online which she totally understands me and i traveled to meet her. I wish to propose to her in the near future maybe in a year . I was looking information on the k1 but i am unsure of what will happen. Our relationship is bonafide but the process and the word Immigration sound terrifying. Is there any concerns for this type of case. Any help will be gladly appreciated!

Well yes, you need to be free to marry to file a K1.

what state are you in? makes a difference as some require you to be legally separated a year before any divorce is finalized

and what country is she from ?  also makes a big difference  as your best advice to from those going thru the same embassy

hard to get a K1 from some of them

so,  can you apply and get a K1 visa ?   maybe and maybe not

Be ready for scrutiny at interviews, HCM consulate is no fun. Build up the current relationship with many visits then you can try it, don't rush. Good luck.

Answering your question, I personally don’t see any obstacles to K-1 except maybe the sponsor’s  income requirement. You are aware of your USCIS financial obligations to your ex, aren’t you?

And make sure your current girlfriend is well aware of your previous marriage.

 

What have you done to resolve the cultural differences? Marrying someone else from the same foreign country is likely to have the same issues. Have you since learned the language? Or have you spent considerable time in the country? If not, I see a repeat of this thread in another 4 or 5 years...

You first need to divorce. That can take time. Focus on your relationship and then file the k1.

Being with someone from another country is difficult.  Those of us here who have successfully navigated the immigration process have also navigated the long distance relationship and cultural differences as well (for the most part).  We all have our own reasons why we took this journey.   But for someone young, who have just ended a relationship with a foreign national, I would recommend some time to evaluate thing first before heading down the same road again.

 

 

As far as planning to get a fiance visa "down the road", you will need to get divorced first.  Fully divorced, that is.  Not separated, not legally separated, etc.  You will have an additional financial burden, because the I-864 for your Ex is still in affect, and you will need to support another.  And you will be under further scrutiny by USCIS and/or the Embassy for sponsoring another foreign national so recently from divorcing your previous foreign national. 

Perfect response.

 

USCIS is gonna suspect that you are getting some kind of benefit ($$) for bringing vietnamise women to the USA.

As others have said, what makes you think this time is gonna be "different"? You're "talking" with some lady from the exact same country as your ex only a month after you and your ex officially separated and you're already thinking of how to bring this new girl over to the US. If it talks like a visa mills, walks like a visa mill...come back in a couple years and let us know how this all went down. :pop:
