Facing problem regarding date of birth and name on Birth Certificate

Hi everyone,

I have a problem regarding my Birth Certificate. For that I even sent an email to US Embassy in Delhi. And they said that I should tell my problem to consular officer and bring a supporting document.

Anyways this is my problem.

My problem is that I have ORIGINAL BIRTH certificate but in that my Name and Date of Birth(DOB) is different from the Date of Birth displayed in my Passport and Matric (10th class) certificate which displays your DOB. So if I send my Original Birth certificate with the documents then that date will not match with my the Date displayed on my passport. My parents changed the date when I was in 8th class. Its not my fault. And from that moment on I have been using the same Date Of Birth on all my forms and certificates. I don't show my Original Birth Certificate anywhere and whereever I have been asked for my birth certificate there I show my Matric certificate.

And in India when a child is born he gets his real name after 15 days or 1 month. Thats how things works in India. I have my voter's id and ration card to support my name.

So please tell me what should I do? Your help will be really appreciated.

Hi everyone,

there are 3 approaches for this issue (i am not a lawyer , but this is the advice i have got from one)

approach 1: ignore your original birth certificate , if the original birth certificate and passport mentioned place of birth are different , then go to the birthplace mentioned in your passport , consult the local registrar of births / muncipal offcials and apply for a new birth certificate with affidavits (100 Rs legal stamp paper) from parents stating that you are born at home , not a hospital delivery , on the date and place mentioned in the passport. Now depending on the state, city or town or gram panchayat they take thier sweet time in issuing a new one. (pay for chai & pani , the faster it gets ) .

approach 2 : ignore the original birth certificate again , consider the place and date of birth mentioned in the passport as the real one , chennai consulate always suggests applicants incase if they cannot obtain a official birth certificate from registrar of births , to furnish a secondary birth certificate , which is nothing but an affidavit form your mother stating that yours is a home delivery and was born on the date & place mentioned in the current passport . With another witness affidiavit form your aunt or any of your mom's relation stating that it was a home delivery and they were present at that time. so the isssue is resolved. never show your original certificate at consulate its a very serious offense according to the law if the date of birth and place details are tampered or whatever.

approach 3: Go to the nearest HIGHT COURT file a writ petition , with affidavits from parents , which is all in all a day's afffair. HIGH COURT decree on your petition would squash any certificate in the world. It is the final or supreme ordeal.

Lastly , i have no idea where you belong to , i mean part of the country , but in HYDERABAD it works. One of the 3 approaches are preferred here.

Fill the G-325A with the date that's in the passport, and send in a notarised copy of the 10th-Class certificate.

As for the original BC--take that with you when you go to the US; a copy of it will be needed for the AOS.

I agree with Agnar, get the affadavit of birth done. Along with your tenth certificate, you should have no problems.

ok I'm confused. I thought the point was for Sam not to use the original BC in the US? He will either need to get a new one with the 10th certificate's info or get an affidavit. Question, what does he need to show in the USA to get a DL?

I'm from Chandigarh (Punjab). Btw I was born in Chandigarh and its on my birth certificate too. Only discrepency is with the Name and Date of birth.

My case will go to Delhi embassy.

So I guess I'll go for an affidavit. I hope they accept it. :)

Can I use the same affidavit for my AOS and for DL in US?

As Cherry said that I need my original BC for AOS. So if I show them my original BC then they will think that I'm a fraud lol. And I'm not. They should know things like that happens a lot in India.

Main thing is to get as much evidence as possible showing you are "who you say you are".

School records, tax, postal IDs etc.

Affidavits from 2 people that attended your birth may help also.

One terrorist made it in on a phony BC so DHS takes a close look at BCs.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Better take a legal advice and once for all get an official birth certificate from registrar of births , coz you still have plenty of time for anything. If not now , later you would be in deep trouble.

Luckily in India you can get any certificate , coz its a very liberal country :lol::lol::lol: . just kidding

keeping in view about AOS in future and its serious legal implications , better go for a permanent solution.

Well I have Voter's ID card, Ration card, Driving licence,School and College records, Passport etc to prove who I'm.

And I also took legal advice and they say hide the BC otherwise I'll get into trouble. They suggested for affidavit.

And I can't go for duplicate birth certificate 'coz now they have records for the past 25 years in the computers so can't go for a duplicate BC.

All I need to know now that if I show that affidavit for AOS then will it cause me any trouble?

Affidavit is my only option.

Hi Sam, as you know my husband did not have a BC so we provided the Affidavit from his mother and Caste certificate, both in India for the interview and for SSN here, they worked fine. We just sent off the same two things for the AOS and are hoping for the best - will let you know!

And what about driving license. Are you going to show the same two things with SSn?

I don't know why they want your BC in everything. In India if they ask for BC and you show your 10th class certificate then they don't even ask for BC 'coz its 10th class certificate displays your correct Date of Birth and Name lol. All the best for the AOS process. :)

Thanks for the best wishes. And yes it's a hassle because BC is not needed in India but seems to be so important in USA. My husband does not have a driving license, he will apply for ID card once the SSN comes. He got the SSN card last week with wrong name spelling and they will send another one in a few days.
