Timeline

Fathers still have to prove relationship with their children when you are immigrating children.  If Father have not had any interest nor have been a part of their lives since birth, then US Embassy is not going to allow them to immigrate.  In other words, if he has been a deadbeat dad, and now he is coming to US, US is not going to allow the children to come he has not cared for children in all of this time, why now.    

 

I am surprised they did not ask for a DNA test.

The CO said dna test was optional because he would still need to prove an ongoing relationship with the kids. His presence has been there since both were born. They live with him full time. He is their sole caretaker. And we proved that already.

One child 19 and the other is 10

They never said anything to us concerning custody. They took the sworn letter as if that was enough.

It is fairly unusual for the father to be granted custody is he a widower?

No he is not a widower. The mother has been dealing with issues since we met. He has been their sole caretaker for 7 years.

I take it that this was an informal agreement?

Yes it was informal. She wants them to come. We are trying to figure what we need to satisfy immigration because they never asked for anything from the courts. She gave a sworn statement and the CO took it and never said it wasn’t enough.

Do you have proof that the kids have been living with him?  School records, doctor records, etc... - Sounds like that is what they are looking for.

Yes, On the second interview we submitted all of that. We submitted school records, doctors records and photos from since both of them were babies till now. The CO took the sworn statement from the mother And didn’t ask for anything else. We asked if they needed to take DNA and the officer said no.

A friend of mine had a nightmare of a time getting her step-children  here, but they are both here now and one just got her citizenship.  She started her own immigration practice, and has dealt with this in Jamaica - Her website is here: https://thelegalforrest.com/ - she might be able to help, or have some thoughts.
