My understanding is that unless you are in New York, Vermont, or Connecticut, the I-944 still applies.  I'm sure someone will correct me if I am wrong....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There is nothing in this page that says only residents of NY etc. are exempted. I just filed a few days ago and I did not include the I-944.

 

As long as the July 29, 2020, SDNY injunction is in effect, USCIS will apply the 1999 public charge guidance that was in place before the Public Charge Rule was implemented on Feb. 24, 2020 to the adjudication of any application for adjustment of status on or after July 29, 2020. In addition, USCIS will adjudicate any application or petition for extension of nonimmigrant stay or change of nonimmigrant status on or after July 29, 2020, consistent with regulations in place before the Public Charge Rule was implemented; in other words, we will not apply the public benefit condition. You might want to file asap before they change it.

Great.  Maybe they will not enforce the requirement.  All I know is that the ruling applied only to New York, Vermont, or Connecticut.

They will probably implement it again soon so people should file asap before that happens

the entire US government is a complete failure. has been for decades and decades. 

 

i would not be surprised if someone gets an RFE for something that doesnt exist anymore on their website..

The decision from the second judge gives USCIS the choice to request the form for the other states again, but USCIS needs to give a notice first requesting it again. So far, they haven't changed the requirements and the I-944 is not needed.

I submitted mine on 8/26 and did not include the I-944 for myself and my daughter. I hope it goes through OK. Seems silly to need something that they aren't providing but it also wouldn't surprise me. I printed out their info saying it isn't needed as well as a letter and underlined parts lmao. So we will see. Still waiting on notification.

For cases submitted on or after July 29 and before the reimplementation (that still hasn't been announced) it's not required, as USCIS would open themselves up to a lawsuit they know they would lose if they do start requesting it later for those cases. There are no links on uscis.gov that currently lead to I-944 PDF and their most up-to-date page says to not include I-944: https://www.uscis.gov/green-card/green-card-processes-and-procedures/public-charge/injunction-of-the-inadmissibility-on-public-charge-grounds-final-rule
