September 2020 - AOS Filers

On 8/29/2020 we filed the AOS as K1 recipient and it was delivered by USPS on 8/31/2020 to Chicago Lock Box. Now it's 9/30/2020 we have yet to here anything nor has our check been cashed, so getting nervous about what's going on. Little back story 😮 our K1 visa process was in 2019 and we married by sep 2019. Was not able to file AOS @ the time because my income was insufficient for the previous year but now after redoing the medical exam and etc and I found a co sponsor we picked up and continuing where we left off almost a year later 🙄😩. Anyways I'm seeing mostly everyone's post here that within a 2 to 3 weeks time frame their AOS package is being accepted and checks cashed etc and we are concerned hm a month later nothing 🤔 I guess I can try emailing the LockBox and see what's going on?  anyone else having to wait a month +  please advise. Congratulations to everyone getting there's processed 🎉 

*UPDATE* 

Happy to say on 10/5/2020 my personal check was cashed as a ACH payment by USCIS chicago payment. Will keep a eye out for receipt by electronic or mail. Slowly but surely!!  It was accepted.

Yes patience is a virtue! True everyone's cases is different and will have different outcomes but it was only natural to feel like that 😩 plus we are a 2019 K1 applicant.   At lease will be at ease for now 😊

Hi everyone,

 

This will be my last post in this thread since something important came up (not worthy of emergency Advance Parole) and my wife had to go back to Ecuador. Everything will work out in the end, but for now it's off to the CR-1 forum for me!

 

The latest timeline was:

 

8/31 packet mailed (USPS Priority Mail Express)

9/1 delivered to PO Box

9/18 credit card charge processed

9/21 3 text notifications received

9/26 3 NOA1s received in mail, receipt date 9/1

AOS For Parents

 

-8/29/2020: Sent packages
-8/31/2020: Delivered to USCIS (PD)
-9/16/2020: NOA1 dates for all forms
-10/03/2020: Biometric appointment letters received
-10/23/2020: Biometrics taken
-11/18/2020: RFIE for I-944
-12/18/2020: Sent I-944 package
-12/22/2020: Case status updated to Response To USCIs’ request for evidence received
-12/29/2020: I-693 deficiency letter received
-1/4/2021: EAD status changed to “New Card Is Being Produced”
-1/5/2021: AP & EAD status changed to "Case was Approved"

Timeline

Question about the I-944. I did not file it originally, but I'm starting to prepare for it in case we receive the I-944. One big concern I have is that my parents have never lived in the US, they came to visit in March and we applied AOS on August, so they have no US income, tax returns, or anything like that. Most of their financials (as I imagine most immigrants coming from countries in development) are not really comparable to the US poverty line, so I'm real worried about income and assets here. I believe we can provide most of the info for my parents:

 

-Education (bachelors for my mom  & high school for my dad)

-Certifications (my mom is a certified insurance agent in Mexico, my dad has some technical certifications in welding and such)

-We have statements from Mexican Social Security Administration showing my dad has worked for the last 30 years

-They're both under 60, no major health concerns

-We have the letters from transunion & experian of no credit history

-No tax returns or W2 since they don't work in Mexico. My mom declares taxes since she is self-employed, but my dad has always paid taxes through payroll, in Mexico, you don't do individual taxes unless you are self employed, taxes are sort of your employer's responsibility. 

-Their assets are minimal, they still owe their house, probably have less than 20K USD in equity and they don't have any sorts of savings except for their retirement savings which are about $100K USD 

-They're not eligible for US health insurance but my mom, being an insurance agent has a major medical expense insurance from a Mexican company, it only covers emergencies in US, not medical conditions except for emergencies.

-The biggest negative factor they got going for them is that their income would probably amount to only  $2.5K a year (yeah, it's pretty rough for them down in Mexico, hence why're they're trying to immigrate)

 

What's their real shot at getting their I-944 approved with that low of a salary and not enough savings to compensate for this? I feel this is ridiculous for most latin american countries, in Mexico, an engineer with a degree would probably make somewhere around 15K to 20K a year, and those are the high earners. I just don't see how they would expect my parents to earn over 27K a year. 

 

Do I have a shot by painting a good picture with the rest of the documents I talked about? Also, my I-864 is strong but I don't know how much would that help their case for the I-944.

I received another rejection, this time it didn’t state that I paid the incorrect fees, and I had posted on VJ before and believe I answered one question incorrectly.. so I’ll have to send in my paperwork for the 3. Time. Needless to say, I am really not motivated anymore. Good luck to everyone! I’ll be on the October group I guess. Yay me.

If you get an NOA for a form in the mail, does that mean they have "accepted" your form? Or can you still get rejected later because of errors on the form, etc.? (Or does that then come in the form of an RFE rather than a rejection?)

I don't have any advice but I understand how silly this whole thing is. I have to do the I-944 for my three year old and she has.. no assets of course. There should be an age requirement.

I'm currently filing the forms to send my AOS this month.

Would anyone be able to help me out with a couple questions?

 

I-944 - 

1.should I mention trainings that don't have certificates for in occupational skills?

2. for the second question in A should I answer yes or no?

Do I have to write a intended date of departure or "unknown" would be okay? What did you write down?

That's  why the I-944 was designed and implemented. They want to keep immigrants out. That's  why this form is sort of a wealth  test. That's also why immigration groups have fought so hard against this test and other tools they use to trip you up. It's sad but true, hopefully it gets alittle better next year, but till then it's  a ####### shoot!

Timeline

Update: So we got approved NOAs for Forms I-485 and I-131. We got a refused NOA for our I-765 Employment Authorization due to: (1) incorrect payment amount and (2) outdated version.

They received our AOS package on September 3rd and this notice was sent on the 26th. 

I don't understand how they came to this as we did everything correctly.

Our CC was charged $1,225 and we specified in every form's cover letter that we were filing concurrently I-485 so we were exempt from paying the I-765 filing fee. 


The form's edition is 08/25/20 which is the correct edition (USCIS officers have nulled a printed number under the barcode with black ink?)

Anybody have any suggestions as what next steps are? Do I fight this? Do I pay the fee?

Sorry to hear that! We were in a similar boat...same reason, but our fees were correct. On our FIFTH submission, we were finally successful (not one thing changed package to package-- infuriating!) Hang in there and good luck.
