HELP DENIED I751 due to USCIS error

This is so stressful, after waiting for about 6 months to finally get our interview schedule, we finally got it August 4, 2020 at 1:00pm. Same day 3hours before our interview we starter getting a total of 5 tx messages said case status updated, and emails confirming the interview had been cancel. I log in to my account just to find out the same thing Interview Cancelled. Because of the pandemic we though it was normal. But call customer service anyways and told me something, interview cancel wait for them to reschedule. On Thursday 6th, 2020. case status update and emails received. Our case Decision had been made. DENIED.....reason..... we DIDN"T go to the interview therefore case was abandon and DENIED whaatttttt? They Cancelled US. I called them right away and explain them it was their mistake not ours. They send a Notification to that specific office, bringing that to their attention. Today Aug 12, the office where had our interview send and email saying that it was brought to their attention about the error, but they had already made a decision, but i could file a motion to reopen . they must be kitting me, now we have to pay $675 to do that. and on top they had the guts to add they are committed to do they work on a timely manner and EFFICIENTLY . helppppp any one going through the same nightmare?

We always advise other members to go to interview date no matter what, to be on safe side. Now you need to talk to a level 2 agent to require an appointment with the officer who is in charge of your file. You need to gather proofs that they canceled your appointment. Do not 100% low level representatives, they are misleading robot sometimes.

Someone argued and advised op sometime ago not to attend canceled interview. Op didn’t want to go because of distance. This is one of the reason why distance shouldn’t matter at all. If scheduled and canceled, we must always attend to avoid “had I known”, unnecessary expenses and delay. Well we all know its USCIS fault but you have to pay and proceed if not you loose everything. Goodluck.

It is important to understand that USCIS have multiple scheduling systems that aren't linked together. It is always advisable to show up for interview date (cancelled, postponed or re-scheduled) either you did or they did. As suggested, call and ask to speak with a tier 2 officer and ask for info appointment to see officer in local field office in charge of your case. Good luck.

We learn our lesson the hard way.  We spoke to and Officer and he just advice us to wait for the response on the form i-290b which we already did, we hope to receive good news on that. We just hope they dont take another year to respond.  is an Officer the same as tier 2 officer? Thank you for input.

Because of this pandemic  and all the prove on our hands we really though it was normal. little we knew all the headaches this will bring us. thank you !

Did you ask to be transferred or is it the first person that responded when you called that told you. Tier 2 officers are immigration officers with more details about your case than the information specialist (tier 1- who answer after you get through Emma). I would suggest you confirm from a tier 2 officer again if you were not transferred during your call.
