but that needs to be sent in 1st mailing to USCIS as that is what embassy sees when they get the packet

no embassy cares about the additional info bought to an interview / they go by what they read before interview happens

and if high fraud embassies see only 1 visit ,  that is what they go by

Please don't worry too much.  Your case will be straight forward and simple, even with the 1 year break in relationship.

 

But please review the CR-1 process.  While K-1 may seem easier and faster (at least, faster in pre-Covid times), the huge problem with it is the AOS process after marriage.  You will basically be locked inside the country for 6 months or so, not being able to travel outside the US or get a job.    While waiting for your CR-1 process to be..er..processed, you can visit using your ESTA.  Spouses are exempt from the travel ban.  

 

The trick would be for you to meet to get married, but as someone posted earlier, you can spend 14 days in a non travel banned country and then fly to the US.  Another option I have read is to meet in Gibraltar and get married there.

this is so important as many are difficult for K1 petitioning 

 

I would strongly consider marriage and the spouse visa as the new AOS fee for adjusting status in the US after marriage here is going from $1140 to $2270 on October 2nd 

and as said above many new K1 immigrants have issues with driving licenses,,  SS cards, etc

Before the fee changes the total AOS is $1225 and includes the EAD and advance parole

the new fee does not and now  there are fees for EAD and the AP

 

However, once the new rule becomes effective, the total package for the AOS application will be more than double as it will increase to $2,270. And applicants will also be required to pay a fee of $590 and $550 for their advance parole and EAD renewal applications, respectively. 

 

 

you apply for all 3 when adjusting and this has been talked about on here and in news since 1st proposed

Adjustment of Status (AOS), Advance Parole: Green Card applicants, who file for Adjustment of Status (AOS) using I-485 have to pay new fee for EAD (employment authorization document) and Advance Parole(AP) travel document. In the past, AOS applicants could file for EAD and AP document every two years without paying fee, now they need to pay fee.

  • Also, the fee for children was $750 before, now it is same for everyone and set to $1140.
  • Total Fee for Adjustment of Status using I-485 + EAD + Advance parole is $2,270. The total was about $1,140 before as there was no fee for EAD, AP

While the I-485 fee is going down by $10, USCIS will start charging for the I-131 Advance Parole and I-765 EAD.  Currently those two documents are free when filing the I-485.  While not required, most people have found it beneficial to have AP and an EAD.

Though whether most people will feel the same when they're about $500 each, rather than free, is probably an open question. Once processing times have settled down post-covid and we have a good idea of how long various field offices are really going to take for AOS again, I don't think many people will file for EAD/AP if the difference between expected time to EAD and expected time to green card isn't very long, especially if they successfully get an SSN during the K-1 90 days (or had one previously) and/or have no short term international travel plans (this risks running into something you think is an emergency but USCIS does not, but I think most people without a lot of disposable income would think it worth the risk unless they think the chance of that happening is high) and/or don't plan to work in the immediate future (though this one's less likely, as a lot of states require an EAD to get a driver's license).

The new totals depend on the following;

  • Filing for I-485, I-765, and I-131 new total fee: $2270. ($1045 more expensive than right now)
  • Filing for I-485 and I-765 new total fee: $1680. ($455 more expensive than right now)
  • Filing for I-485 and I-131 new total fee: $1720. ($495 more expensive than right now)
  • Filing only I-485 new total fee: $1130. (It's actually cheaper than right now by $95)
