I have green card Gf pregnant and illegal

I have a situation. A friend of mine has a gf and his girlfriend is pregnant with twins but she is illegal. Also, she has a daughter 11 years old. He is married with his wife who brought him here. What he can do for his gf to stay in the usa.  . 

 

P.s. she is planning  to have the babies in the USA

 you cannot sponsor pregnant girl friend when you already have a wife. not any option here legally

He may be able to sponsor her once if he legally marries her (after getting divorced, obviously). But even then, you said his current wife brought him to the US. So there is at least a 5 year ban between when he got the green card and when he can sponsor another spouse. And even then, it's going to look very shady, especially if they are from the same country.

There are zero legal options. First of all he is currently married. Even if divorces the wife and marries the GF, the GF can't adjust status inside of the US. The overstay results in many INA 245(c)(2) adjustment bars:

Gee. First, heading says “I” and first post “my friend”, ok that notwithstanding...

the situation is an immigration mess, as well as a relationship mess. 

- how many years has he been married to his wife? This matters: does he still have to do removal of conditions? Does his wife know about the girlfriend and pregnancy and if not when does he plan to tell her?

- how long has he had his green card? Did he get it through CP or was he already in the US when he met his wife?

- because he got his green card through marriage he would either have to have his GC for 5 years or be a citizen to sponsor his gf for a green card, in theory. BUT 

- spouse of a green card holder does not forgiven for overstay so even if he divorces and marries the gf, she still can’t adjust.

so no way for him to enable her to stay, at least for a long time (only way is divorce then citizenship in the interim)
 

If she’s planning to have the kids in the US the kids will be citizens, but that will confer zero benefit on either her or your friend, at least not for 21 years.

As an aside, if he ever applies for citizenship, he’s going to have to fill in start and end dates of marriage(s)...and birth dates of all kids. Part of the reason I asked about how long he’s been married already. Hope it won’t cause an issue about bona fide marriage.

Hmm. With the children’s birth dates meaning it will be impossible to hide the adultery from an n400 form (of course one should always be truthful anyway), it seems adultery is still considered a conditional bar to naturalization regarding good moral character. So clear evidence of that in the 5 years before applying to naturalize could be a problem. Puts both citizenship and an adjustment of status for next wife even further away.

The honest truth is there is nothing that he can do. She can have the babies here and they will be citizens, but that will do nothing for her. There is no way for him to make her legal in his situation now.

I hope he realizes how expensive a twin birth is. Highly likely that a c-section will be required and some NICU time. These things don’t come cheap in the country with already the highest medical costs in the world.
