USCIS confusion

Timeline

Hey y'all so... (Long Post) 

I applied n400 in July 2019 was scheduled for interview April 2020 for NYC Queens which was then de-scheduled... I also have outstanding i-751. Here's the timeline of events based on my account notifications and inquiry

 

-March- Interview de-scheduled Queens

-April- I moved (same state different city new office should have jurisdiction)

-April- updated my address using form for both cases

-May- updated status online account my n400 has moved and new office has jurisdiction

-June- did inquiry for i-751 - case moved to office with new jurisdiction (Albany) received another extension letter NBC listed as address

- August- interview rescheduled for N400. Letter states Queens as location for interview. Letter has my new address ( which means they obviously got the change of the address right? )

-Today Aug - call USCIS my n400 is at Queens but my i-751 is in Albany

 

The tier 1 rep I spoke to say they didn't update my address in all the right places so my case N400 never left Queens... Then what was the change in office notification I got in May. It was obviously already in Queens if my interview was scheduled, right? So if it got transferred should it not have been to Albany? Which is why I never even thought to do an inquiry. 

 

Anyways the rep is telling me I should change the address again. I don't actually want to. I'm much closer to NYC, (I actually still work in NYC) than I am to Albany and additionally, I don't want to then have to wait again for my interview to be scheduled in Albany. The rep also suggests that they might not actually do the interview when I go because they'll ask where I live and will say they can't do the interview bc the office is incorrect.  I requested a tier 2 call back but I have no hopes in that. 

 

So I'm looking for suggestions and insight into this one. I know they can't actually approve my n400 either bc I can't do a combo if the cases are in different offices. What do you all think.

  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)

  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

That's a really annoying problem.

 

If it was me, I'd go along to the interview anyway, but be honest about your change of address.

 

They may terminate the interview right then, or they may go ahead and do it anyway. If you're close to NYC anyway, I don't think you have much to lose.

Thanks! I appreciate your response. That's what I was thinking too. Gathering the ideas of who is willing to weigh in because I'm obviously emotionality attached to it and need some objective ideas. I was thinking of changing my address on the i-751 back to the city where my MIL lives (this is not the address where I actually lived) but I would still have to say I only stay there sometimes which really is that I visit there a lot... Sigh

I would go forward with the interview - especially since it's not a far drive - They made the error, after all, and maybe someone will recognize that and let it go forward.

Go to the interview. Take the letter they sent you to the interview to show the address change. Considering everything is pretty much virtual when it comes to government paperwork, the paperwork may be able to be transferred via email of internal systems.

Let me assure you it is NOT virtual.

During my interview, the USCIS officer had my complete file, consisting of ALL original documents, not printed copies.

I have spoken to people that have had their interviews rescheduled due to the file not arriving at the field office.

Thanks all. I plan to turn up and take my chances. 

Agreed the A-file is a physical file. Hopefully they will transition to virtual/digital in the near future. That's why transfers are such a pain.

Update

I did end up getting a call back from Tier 2 who told me not to go to the interview and request my file be transferred because the Queens office has no jurisdiction over my case and my i-751 was not adjudicated. Said they would not do my interview. I took a chance and decided I would lose another month by waiting to see what happens instead of asking for the transfer.  

 

Well I went and they actually did the interview even though they did acknowledge that it was the wrong office and even though my i-751 is still pending. The person who interviewed me said her supervisor said to just do it since I was already there. But they can't Officially approve it because of the pending i-751. 

The plan now is to get all cases in their right offices and once the ROC is adjudicated, they'll approve the n400. More waiting but at least the n400 interview is done. I thought they wouldn't even do it since when I was waiting two persons got told that they would have to be rescheduled because there was not a decision on their i-751. I'm so relieved.
