Timeline

Good morning all,

 

Does anyone know what happens if someone decides to cancel K-1, get married, and go for CR-1 instead as far as the records in the system? I am planning on sending a letter to USCIS once we get married to cancel I-129F. 

Will all the information for the I-129F be in the same file as the I-130? I assume they search your name/ social and see all the petitions you have done? I am not worried as all information will be the same, but just curious how they keep up with all of that. Could they ask about why we decided to cancel the fiance route and go the marriage route?

Found love, thought I wanted this path, two years later realized my partner was not worth all the stress 😁

Hi, so we did this. It was a while ago and we sent a letter (we had it counter signed by a lawyer but I don't think that's essential) to the Embassy (that's how far our K1 got), for us they replied to let us know they'd withdrawn our case. Then we filed the I-130 and put a copy of the withdrawal letter in just in case. We didn't have any other repercussions. I hope that helps.

Your plan seems fine. 

 

As a bonus, your I-130 has a chance to be processed faster than normal if USCIS already did your background check as part of the K1.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Every K1, Immigrant or work visa beneficiary gets an A number that sticks with them forever, just like a SSN.  In theory everything is related.

USCIS does not ask or care.  It could come up at the consulate.  Also things like did you know your petitioner filed for X person way back in 1990?

 

Also note that you have to declare if you have EVER filed a petition before on the I-130.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I can only go by my timeline.  My K1 took 6 months to get approved (June 2018 to Dec 2018).  My I-130 took exactly 90 days to get approved.  1/2 the time, and faster than most I-130s at the same timeframe and service center.

Some background checks take 30 minutes,  while others can take a full day.  You do the math.

yes, i do

denied a K1 and then withdrew it to apply for CR1

and when interviewed in Casa all the K1 documents were with the package they gave all  those documents and photos for K1 back to Adil after the CR1 interview which was good because in 2009 we had to send originals (birth and all)
