I am so confused when filling out the I-751 form. Who is the petitioner?  Is it me the U.S. Citizen Spouse as it was on the AOS and K1 visa forms? Or is it my wife who is the permanent resident who arrived on a K1 visa?  Thanks.

For I-751, the Conditional Resident is the "petitioner". You are just the "spouse" that signs in Part 8: https://www.uscis.gov/sites/default/files/document/forms/i-751.pdf

I'm not sure if it really matters but personally I would just have her do it because it is solely her petition. She could file for ROC even if you weren't together, unlike the AOS where she needed you to adjust status. Now if you are translating the documents for her you would complete and sign the interpreters section of the form. Like the above poster said you would complete the part 8 section

I followed the VJ guide.  I, the US Spouse, signed the cover letter..........although I don't think it really matters.

Senior Master Sergeant, US Air Force- Retired (after 20+ years)- Missile Systems Maintenance & Titan 2 ICBM Launch Crew Duty (200+ Alert tours)

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

That's what we did. It's sort of a "joint filing" in the sense that the US citizen spouse has to sign the form too, so it made most sense to us that both petitioner and spouse signed the cover letter too. It likely doesn't matter, we just felt it made more sense that way.

 

The VJ example makes no sense to me, it just makes it look as if the US citizen is doing all the work and filing the petition on behalf of the actual petitioner.

The AOS petitioner is the immigrant actually.

Yep, a cover letter is not even required. I didn't sign mine at all.

Who signs the over letter isn't important since I didn't even have one. 

Cateogory: CR1

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:
