Sent in the old I-765. Will our package get rejected???

Anyway... Hopefully, people who submitted the old I-765 form will receive the same I-797C package with the green page, and then can just re-submit the new form with the green page on top.

 

 

That's great, yay!!! Still nothing for me, I'm starting to think that they never actually delivered my package (they never updated my tracking to delivered or anything). I'm giving it until Monday, and then i'll call USCIS and see if I should send in a new packet 🙄

If merember correctly you used USPS...  It's almost a waste of time calling the USPS customer service number.  Print the tracking history and take it to your local post office, and ask the manager to please research it for you.  Their internal system contains details that aren't copied to the public tracking info page, and maybe there's something definitive there.

 

I ship a lot of stuff via USPS, but when it comes to critical things, such as what we all send to USCIS, I use only couriers like FedEx, UPS, DHL, etc.  USPS usually does good, but when they fail they fail miserably, and though relatively-small, their failure rate is clearly increasing.

Right, I will never use USPS for important stuff like this again after this. That being said, USPS is the only carrier that postmarks so if I want to make sure that I will be good sending in my package close to the Oct 2nd deadline, they would still probably be my best bet. While, UPS or Fedex might be faster, I'm afraid that they will not look at the application until after Oct 2nd and without the postmark, they might reject it.

In several places on the USCIS website you will see this sentence: "If you send your application or petition by commercial courier (for example, UPS, FedEx, or DHL), we will use the date on the courier receipt as the postmark date."  For example:  https://www.uscis.gov/news/public-charge-fact-sheet        I believe it's also in the various form-instructions PDF files.

 

That's the date you tendered the package to the courier.  On FedEx labels, it's at the top right of the shipping label:  "SHIP DATE:  DDMMMYY"   The date will also be on the receipt you receive when you drop off the package, and it will also be on the proof of delivery letter you can download from the courier's website after the package is delivered.  As I noted in another post, attached to the I-797C was a photocopy of the shipping label from my package, so it seems USCIS cuts the label off the package and saves it as evidence.  Some couriers' depots are open late, FedEx nearest me is until 8PM, so if you're too late in the day for USPS then this could be a lifesaver.  (Maybe this will be helpful to someone in the future.)

 

And, in case some future person reading this thread misses it:  Couriers cannot deliver to a post office box, so you must use the actual street address of the appropriate USCIS office, which is also listed in the applicable "where to send your application/petition" section. 

 

I like the idea of an important package being delivered straight to the person/office, rather than to a post office box where it could languish for who knows how long, or worse, dumped in a parking lot or alleyway, or be eaten by the postal gremlins, and etc.  Of course the couriers have had a few of their aircraft go down, so...none are absolutely safe.

Yup (courier receipt=postmark date), but just a note that is explicitly referring to change of rule purposes. Priority Date (a.k.a. receipt date) will follow federal regulations regardless of who delivers it (USPS, FedEx, etc.); 8 CFR § 103.2(a)(7)(i): "USCIS will consider a benefit request received and will record the receipt date as of the actual date of receipt at the location designated for filing such benefit request whether electronically or in paper format."

I didn't know that since I don't ship items very often. Really good to know. So in other words, I would be perfectly fine using UPS instead? I would prefer using that then.

So it would have to be recieved before October 2nd? I'm just making sure that i'm understanding your correctly.

For fee schedule purpose, courier receipt/postmark is what matters. Later for USCIS processing times inquiry, receipt date (day USCIS received it) is what USCIS uses: https://egov.uscis.gov/processing-times/

Nothing! I'm giving it until Monday. If I don't see anything by then, I will call USCIS and see if it is worth sending in a new package. I'm just not sure if mine was delivered in the first place 😩

You might only receive the automated response that your email was received, but nothing to lose by trying.

 

Also, were you able to get a USPS manager to research the tracking for you?

Two things:

1. Send an inquiry with your delivery proof to lockboxsupport@uscis.dhs.gov

2. Call the USCIS Contact Center at 800-375-5283 and ask if they can search on your name(s) for any notices, because you suspect that one may have been sent but you haven't received it.  Maybe Lockbox sent something but you haven't received it (maybe because the mail was dumped in a parking lot, alleyway, etc.)

 

All of my "people" in USPS are now retired, but they've been telling me they hear that "bad (stuff) is going on" in USPS now.  I haven't had any packages go astray, but sales volume is down 99% so my recent experience isn't a good gauge. As for flats (letter mail,) maybe half of my inbound is 1-3 days late, according to USPS Informed Delivery, which a few months ago during the lockdowns all was on-time.  IMHO, something is up, or maybe down, with USPS.

I did forward that to them last week, although I know that they can take a long time to reply, if at all. But like you said, definitely worth a try.

 

I spoke with her yesterday, she is looking into it today and will give me a call back before they close so hopefully she can give me some type of update. I just really want an answer on whether or not it got delivered so I know whether to send it in again or not. It's difficult not knowing for sure!
