I only read maybe 3 lines and after reading, that you got scrweed by the lawyer for 6 grand. I could just tell this is going to be a "bitching" story. Get a life, move on.

easy for you to say... your process is complete... I try to never ####### on someone else... but you just irked the dickens outta me... you are a 1st class, grade A CHOPF*CK!!! how rude can a person be? *disgusted*

char... disregard the "hater"... you vent all you need too... there are those of us who need to know about other's processes - there is valuable information that can be gained... and, there are those of us who really care!!! *hugs*

I seriously admire you. If I were you they would have encountered a screaming madwoman at the VSC by now (or at the border, or at the congressmans office, or all of the above). There are no words for how absurd all of this is!

I read every single word of your original post and my heart simply twisted itself up when I reached the end.

I am so, so, so sorry this is happening to you and your husband. And I hope very hard that you will have a positive conclusion to this nightmare very soon.

I admire your spirit and your heart. Trite as this may sound, please keep your chin up and hang in there.

Have you thought about taking this to the media? Maybe a little bad press would light a fire under the proverbial USCIS @ss. Would be a nice story to show just how broken the system is for those trying to immigrate legally.

What a bunch of #######, I'm really sorry you are going through all this.

Have you considered taking your story to the media (news stations or newspapers)? I would think right now with the immigration bills, this kind of nightmare case showing what some people have to go through to do things legally would be of great interest to lots of media. Good human interest story too. I'm very sorry for everything you're going through. My husband and I went through some tough times in our long road to be together, and my heart goes out to you and your husband and here's a prayer that this nightmare will soon end and you'll finally be able to be together.

Do not quote me on this as i am only an assistant in an immigration law firm. But, there is something called a Mandamus Action that can be filed to force CIS to adjudicate your petition. It is sort of like sueing the government. Now, i said dont quote me because i dont know if you can file this action on a waiver. And, i know you are probably fed up with lawyers, but if you found one that specializes in this then maybe they will have some answers for you. I tried looking up any reference to it in my boss' "bible" but i didnt find anything saying that you can or cant do this.

Again, i dont know if you can do this, but i would do some research and maybe ask an attorney if this is possible. And if anyone out there knows much about Mandamuses, please chime in, I dont want to give out wrong information.

Good luck, and whatever you do, I hope everything gets resolved quickly!

Writ of Mandamus.......I PM'd char about it when she first posted this.....told her that there was a possibilitly for a lawsuit to compel USCIS to complete adjudication on her case especially as it seemed to be held up now waiting on an FBI security clearance that they are suppose to already have.

Char...I'm so sorry to hear all this....my thoughts and prayers are with you both so that something gives soon and you are with your honey.

This is absolutely ridiculous!!!

As for jilanik...your comments seem quite heartless...and serve no purpose other than to kick somone while she's down. Is that what you need to do to feel good about yourself?

Thats mostly what we use the mandamus here for, when there is a problem with the security clearance. Thanks for backing that up, i just wasnt sure if you could file something like that when its a waiver pending.

Char, I did read your post from start to finish and can sympathise with you totally. Read "my story" under my profile and you will see what I mean. We are lucky enough to be together as a family, but have had the threat of my son being deported hanging over our heads for years. I cannot imagine how frustrated, angry and upset this whole process has made you.

We too have stopped talking to people about immigration - I am sure our friends are bored to death by it all because they just don't understand half of what we are telling them anyway. They think that their government can't possibly be letting this happen to innocent immigrants! Yeah right!

We had problems with my daughter's FBI checks - way back - and it turned out that the FBI had sent them back to the USCIS long ago. They are all done electronically and it wasn't difficult to get another copy of the results sent through. Vermont is the office we deal with and they were extremely helpful, but I really think it depends on which caseworker you get and if you can get them on your side.

I would, seriously, send a fax to this number at Vermont. 802-527-4816/4864 (Send it to both numbers because one of them works and the other does not and I can't remember which!!) Mark it for the attention of Mr. Todd Reader, who is the ACD for Adjudications. Outline, as briefly as you can, how long you have been waiting for adjudication of your case and that it is not acceptable that it should be taking this long. Give a phone number where he should contact you and ask that someone call to discuss the FBI check, and it's whereabouts, with you. This is what we did and we had a wonderful officer from Vermont call and help us. She was really helpful. Oh, and the reason it takes so long to get a document from the mailroom in VSC to the officer concerned is, from what she told me, because THEY have to go and collect documents themselves. They are not delivered to their desks. So, you get a lazy SOB that can't go and collect stuff for a week, that's what the "service" you get!

I hope this helps and I hope tht you get this sorted soon. I can't imagine what it must be like being separated for that length of time, due to no fault of your own. You have been patient, far more than most people in your situation would be and I commend you for that.

If ever you want to get the press involved - let me know - I am considering it myself, especially in the light of the compensations this government want to make for illegal immigrants. It really isn't fair that those doing things legally, by the book and spending a small fortune trying to get through the system.
