ANY lie to CBP has potential consequences.  I'd think very carefully before doing this if I were you.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I've been very true and honest with CBP every single trip and have had zero issues. I've even extended 2 trips an extra week or two in the past once there (without the intent of doing it before hand) and haven't had issues. I don't want issues, I want everything done legitimately.

In that case, I'm sure you can see how saying you're staying for one month, when your intention is to stay for 6, is problematic.

 

In your case, with weak ties to Canada, you do risk being denied entry.

Also, at this point I'm going to be going to stay with her for the max 6 months I'm allowed on the Canadian visa passport until we were back about getting an interview date. Is that something frowned upon and will it affect our paperwork?

 

Is your application with NVC already? (Just asking, curious. Our timeline is pretty similar, that's why)

I'm basically wanting to avoid being denied entry. Being a Canadian citizen, having my valuables and a job/career here in Canada that I'd be going back to isn't considered "strong" ties to Canada?

We have been approved, and I'm not sure where the case is sitting at the moment. We got our 2nd NOA and are waiting for the letter to inform us when I can call to book the interview. It's at the Nvc and waiting to move to the consulate in Canada (the Montréal location)

I emailed them asking for my case number and ID so I can follow it better.

A job?  How many can afford to take a 6 month leave of absence, unless they plan to work remotely (and illegally)?

Anyway, you are free to do what you want.  It may go off without a hitch, but CBP are required to screen all visitors for immigrant intent, and B visas are not to be used for living in the States.   So.....just be aware of the risks involved.

Well I technically have a boss above me but either way..

 

I appreciate your concerns and words of wisdom. Staying away from my fiancé is really tough, especially during these times when we are SO close to having the interview and everything done. We just wanna spend the full amount of time we can with each other within the legal limits.

Yea I definitely understand your pain, being separated with no way of knowing what comes next is the worst. However I’d have to agree that buying a return ticket for 2 months when you fully intend to stay for 6 months to avoid questioning would be considered more than just a little white lie, and could have a serious impact if found. Good luck and I hope you two can be reunited soon!

My French fiance used his B visa to visit me for 5 months last year. He was very honest with CBP about his intentions. They asked for his return ticket as well as proof of funds. He got sent to a room for additional questioning, but they eventually let him through. Honesty is the best policy in my opinion. There is a chance you get refused entry, but being dishonest and getting caught is far worse.

 

We are K-1 filers as well and know that we have a long road ahead of us due to everything that is going on at the moment. While I understand that it is very difficult to be away from your lover, try to prioritize long term success over short term gratification. Later on you will be happy you did things the legal and honest way to avoid any potential negative consequences.
