Friend is in need of guidance:

CR6 Spouse of US Citizen - Residence since 1/17/19, expiration - 1/17/21, applying to ROC with I-751 around 10/17/20

CR2 Step Child of US Citizen (10 years old) - Residence since 9/8/19, expiration - 9/8/21, cannot be included with CR6 since residence was obtained more the 90 days after CR6 became a resident.

CR2 Step Child will file separate I-751 at the same time as CR6, providing written explanation. What supporting documents beside copy of green card and child's birth certificate need to be attached?

Anything else that we need to know about CR2 ROC process?

Not sure if it is the same, but we will apply to remove conditions for my K2 stepson separately from my wife because he came to the U.S. 5 months later...

 

Along with required documents, I was told by the USCIS agent at our AOS interview to treat his ROC just as his mother's, including tax transcripts (with him as dependent) and records that are showing him with us at our address.  For our son, that includes health and school records.  We'll also include family photos and boarding passes from our vacations.

 

I won't be including all the utility bills and joint bank statements I included for my wife's ROC.

Send what you have . . . but you could have filed the 2019 with them as a dependent if you also filed for an Individual Taxpayer ID Number (ITIN).  You could still refile an amended return.  My stepson didn't have a SSN when I filed my 2018 return, so I included him on the return with an ITIN application.  We had to file at the local IRS office with him, but it was worth the tax savings!
