Hello guys, im a little new to all this about K1 visa, im the beneficiary. We filed for a K1 visa on march 2020. About  3 weeks ago i went to mexico to meet with my fiance and spent time with her and now we are in the states, I entered on a tourist visa (its been 2 weeks) its not my first time visiting her on a tourist visa after we filed. The situation is the following: she was wondering if we are allowed to get married and then do the Adjustment of status? I now its possible and i know as well that USCIS may think its visa fraud. My intentions when i came to the states was just to visit her and we did spend time with her family and friends. I cant go back to my home country for another 3-4 weeks cause its closed due to COVID. And she would like to see if there is a way for me to stay and withdraw the K1 (last update was case received). We were reading yesterday about the visa fraud and we are sacred of doing something wrong. Any advise will be appreciated!!

Based on what you posted, it is legal to marry and adjust status......Just be aware of the restrictions( no travel outside the US and no work for 6-8 months likely) when when applying for adjustment.  See the following guide:

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I am so sorry you got stuck in the middle of a PANDEMIC, BUT YOU ARE NOT THE ONLY ONE. News reports indicate that people from all over the world have been inconvenienced, or maybe even have died, during the ongoing PANDEMIC. Do you read the news?

 

SO PLEASE -- just STOP. YOU NEED TO count your blessing -- you are not dead, and BE PATIENT. REPEAT: BE PATIENT.

I’m not sure what you’re trying to convey .. but the path through AOS is a legal avenue for the OP, based on the information he has given.
