Hello!

 

I wasn’t sure which forum to use for this question, apologies if it’s wrong. 
 

I’m currently in the US on a K1 visa awaiting my green card. I’m married to a US citizen and my green card is currently pending. 
 

My family are from the U.K. and have flights booked to visit on September 18th. With the travel ban in effect, is there any way my mother/grandmother and stepfather can come and visit me since they’re immediate family? I’ve tried researching this online but nothing is very clear. 
 

I was just wondering what process we could take as I’m not yet a permanent resident or a US citizen. Could my husband even be used to allow them to visit as they’re now his immediate family  and he’s an American citizen?
 

Basically is it possible and if so, what would we have to apply for :)  we have rang the embassy but they were less than helpful..

Sorry to be blunt but it is clear - it’s just not what you want to see. Spouses and minor children of LPRs and USCs are the exceptions. The parental exceptions are for parents of minors. Your family won’t qualify to visit (even if you had a green card already) unless they first spend two weeks in a non-banned country.  Is this latter course an option? It’s something we’ve seen people do successfully.

the family exceptions are certain family members of U.S. citizens or lawful permanent residents including; spouses, children (under the age of 21), parents (provided that his/her U.S. citizen or lawful permanent resident child is unmarried and under the age of 21), and siblings (provided that both the sibling and the U.S. citizen or lawful permanent resident are unmarried and under the age of 21).

Not possible until the ban is over. Also, your family will never be considered husbands immediate family in the eyes of the law

There are some harsh truths that have to be realized in this situation. The travel ban from that region is clear. What you desire is not an exception to the rule. A line has to be drawn somewhere. If parents, grandparents are made an exception then what is next? Adult brothers and sisters with their families? What about aunts, uncles, and cousins? The strict guidelines are ion place for the betterment of everyone. Nobody likes it but it is the best we can do now. If your grandmother were to come here (in a country that has the highest amount of cases in the world to remind you) and contracts the virus, she would be high risk because of her age. That would be more detrimental than a few weeks visit. Yes, they are family but that does not mean they get every immigration benefit as you, your husband, or your minor children receive. There has to be a limit.

 

Once this is all over, they can come over and visit you. Hopefully it will be over sooner rather than later.

oh, on this: I don’t think they were “less than helpful”, there is just literally nothing they can do for you in the current circumstances.

Unfortunately it would be wise to cancel that flight if the flight hasn't been cancelled by the airline already and recover the money. The ban is still in effect and they cannot enter. As we are in the middle of a pandemic, it would neither be wise or safe for them to visit at this time, even if they could. My husband's family who had longed planned a trip to see us this year, also had to cancel. We'd all like to see loved ones, but it's just not possible right now.
