K1 visa stalled at NVC inquiry regarding travel exemption

Hello everyone:

 

Our case has stalled at the nvc. We received our no2 and then silence. I had read to contact the nvc to receive our case number, but that too was met with silence. I understand the waiting part as it has been the overall theme for k1 responses here on the forums and don’t apply for cr1. I get it. I was talking to another couple, who is in the same situation and they are applying for travel exemption due to the ailing health of the petitioners mother; however my readings tell me that the exemption only applies to specific professions doctors/students. Am I missing something? I had written a letter stating my situation about being pregnant. Our baby is now 4 months old. Are there any recommendations from this group to help him get here to be with his daughter?

I don’t think K1 is crucial mission right for nvc to forward to consulates/ embassies.

There’s two separate issues:

1) Bans based on physical presence within certain countries.

2) Most K and immigrant visa classes not being processed yet by the consulate due to COVID issues.

 

Is your issue with #1 or #2?

 

Edit: Pregnancy would not be a basis for an exception to either. Medical needs can be a basis for an emergency appointment, though.

I don’t think Morocco is on the list of banned countries into the USA. And, yes I’m aware of the delay in processing. I was just asking if there are alternatives because of the delay.  Another individual said to look into travel exemptions.  Would our case qualify and would it hinder the k1 process knowing that Casablanca is one of the high denial rates for k1?

 

NOTE:
 

When I was pregnant there was a medical need due to my newly founded blood disorder and it’s impact on the baby. I wrote to have my process expedited because I needed him here to get tested for gene that which is prevalent among people in his region. The letter was included with my petition, but of course, nothing happened and we continue to wait because of Covid.

Correct, Morocco is not a travel-banned country. So it's not #1. So you issue is solely #2 - they have not resumed processing K-1 visa cases there yet.

 

You can contact the embassy/consulate to request an expedited/emergency interview if you believe you have a basis for doing so. I don't claim to know what they will or won't accept. Generally pregnancy alone is not a basis (medical complications can be). But i don't make that call.

In your friend's case, they appear to be attempting to do so under an urgent humanitarian basis to see the mother before she (potentially - I'm assuming here) passes. No idea if they will be successful or not...but that's my guess based on what was stated.

No harm in asking for it. Just don't expect (or plan for) a positive outcome so you can be glad if you get one.

 

There is not a general "alternative"...everybody would be using it if that was the case. They have extremely limited staff right now and can only handle high priority cases.

 

The general refusal rate would not impact eligibility for an expedited/emergency interview.

Thank for your response.  I really appreciate your time and insight.  You’re right, prepare for the worst, but hope for the best. 
 

Given that it’s Casablanca and the issues that others have had to endure, I hesitate as it might result in red flags or longer administration review. It’s just frustrating... Our daughter is growing (4 months) and she doesn’t even know her father.  Probably thinks he’s the computer, but then again, I’m sure im not the only one here. 

 

Please forgive my tone.  I just feel defeated.
