But the CO will use judgement in deciding whether to grant you a visa.  Again, all you can do is apply and see. When do you expect to hear back from colleges/apply for the visa? ( I’m not familiar with timelines for spring intake.) Of course if the course ends up being all online due to Covid you won’t get a visa, but that shouldn’t matter if the focus is on the content of the course and using it back home.

 

 

In maybe 3-4 weeks I should get the replies from the universities. Yes, in case the university decies to take the sememster online then I will attend it from my home country.

My parents will be taking care of my expenses. Yes, I am aware of the funds.

Honestly nobody is confident in this situation. But like I said I do not have a problem attending the semester from here if that is what my prospective university decides to do.

In your situation, I’d confirm that you could complete the course online even if they go back in person. You don’t want to be in a situation where you’ve paid and done a semester or two then can’t get a visa to finish it when they go back in person. I could not find country specific stats, but around a third of student visas get rejected annually, and you probably have a higher than usual risk of denial given your background, so I’d really say it’s a non-negligible risk that you should take account in your planning.

A recent (within the past two years) immigrant intent and a clear indication of not abiding by the terms of your visa/status (a willful overstay -- a consular officer is never going to believe you didn't know about the 90 day limit, it's too much a part of the K-1 information), at least one sibling in the US --all of these things would cause serious doubts about your non-immigrant intentions and make getting a student visa highly doubtful.

Spring will not be post covid.

 

And just because you'll be studying public health is NOT proof you will return home. You really need to do a lot more research about US immigration and how it works. An overstay works against you and no one here is going to venture to guess what you chances are, other than being very low.

you have already gotten good advice. just wanted to add with India you are probably dealing with very tough embassies when it comes to student visas, at least they were very thorough when i went through the F-1 visa process for MS more than a decade ago. with a recent immigrant intent and past overstay your chances are very low tbh. you are free to apply but i would also apply for Masters programs in other countries in parallel if the goal is just to get a good education

Yeah that’s a good idea I shall speak with my counsellor and figure out if I should apply to other countries as well just in case.

That’s true I will have a tough time convincing them.
