Hey guys! Here is our background information. We were married September 16th, 2017. My wife's green card was issued February 13th, 2019 and it expires February 13th, 2021. I believe we should file the I-751 90 days before her green card expires correct? Anytime sooner and it could be rejected I read somewhere. Also I just wanted to confirm that we should be filing the I-751 and not the I-90. Both seem similar. Thank you for your help!

Yes, you file to remove conditions on the 2 year green card using the i-751. Yes, the earliest you can file is 90 days before the card expires.

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

Correct.  You can use this guide:

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I suggest you send in the I-751 package a couple days after the 90 day window opens.

I believe all the folks have explained that I-751 is the way to go...however, just wanted to clarify that I-90 is a completely different form as compared to I-751.

The basis for filing form I-90 is for renewing/replacing your Permanent Green Card or if there are problems/corrections with your conditional green card...

Correct an I-90 renews a unrestricted green card. You must file a i751 to remove the conditions on your conditional green card, I-90 will not remove the conditions on your current green card.

 

To renew your 10 year green card or update your name or some other details on your 10 year green card file a i-90.

To remove conditions from your 2 years green card you must file an i-751 within 90 days of the conditional green card expiration date, if you still married. 

K1 Visa Arrived USA July 2017

Married August 2017

AOS Approved July 2018

 

Filed for i751 joint application May 2020

Fingerprints reused October 2020, and February 2021 and June 2021 (Yes 3 fingerprint notices)

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview

Combo interview May 16th 2022, in Sacramento

Approved June 08, 2022
