My wife and I were married well before the end of the ninety day period for initial entry ended. However, the ninety days expired last Friday and we have not submitted the status change application yet because my fiancee needs additional vaccinations with a civil surgeon. Has anyone ran into problems as a result of a late filing? It doesn't appear we'll be able to get it in for another week, in which case we'll be two weeks over the ninety day limit.

As long as your married in 90 days your fine. AOS can be filed at any time afterwards. You could run into problems if you wait too long though.

As long as your married in 90 days your fine. AOS can be filed at any time afterwards. You could run into problems if you wait too long though.

Not really, if you wait more than 2 years, you file the I-130 with the AOS package. Not advisable, but possible.

You must be prepared to explain why you stalled.

Apply before the end of next month though because the AOS fees are going to sky rocket...

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil
