Yes, it's truly a nightmare. They don't want to help at all. I am going try to call again tomorrow. Last option is that I will fill out the I824 form and pay the fees. I will also keep you posted.

Just to update:

I called again and they stated to wait for the second service request, which I did online yesterday. 

 

From the call, Tier 2 officer was little confused because we got a written confirmation(from 1st SR in an email) back in May stating not to apply for I824.. Tier 2 also advised that I can do a b2 visa then change the status here. But not really sure if the embassy is open or not in Africa. 

 

I also asked about the EO ban of IR5 visas, tier 2 started that they are not aware of the ban but due to pandemic embassies are closed.

I think that if you apply for B2 visa right they will not give her the visa since it is kind of off right now due to pandemic. 
 

i did call today and I was told that to wait since they are the one who reopened my case maybe due to their error of not sending my case to NVC. I might be getting RFE which I don’t know what it would be. So now I need to wait and see what they do about my case.

You received poor and incorrect advice, unfortunately.  It is highly unlikely she would get a B visa, after showing immigrant intent.

 

And even if she did, it is illegal  to enter on a B visa with the intent to adjust status and stay in the US.

I agreed that the information giving to you wasnt clear enough and i know that USCIS  is not issue interview for IR5 type of visa but they do processing  with the paper.

I have an updated on my case. I got these apps that informed me when USCIS touched my case. This morning i was notified that i was sent an RFE and i went only and download the REQUEST.

 

" What You Need to Do
You must provide the following information in order for us to make a final decision on your case.
Please provide clarification of the petition’s destination (whether the beneficiary will seek to adjust status in the U.S. or consular process).


When You Need To Do It
You must either mail the requested information to the address shown below or scan and upload your response using your USCIS online account (if applicable). You must submit the requested information by October 29, 2020. If the request is for original documents, you must submit that evidence by mail.

 

I am writing to them right now and i am using my USCIS Account to respond. this way is so fast.

i sent them a letter through myUSCIS Account stating that my mother will adjust her status at the us consular in Yaounde Cameroon. they already received and back working on my approved i-130 so now next step is to send me anew approved I-130 THEN FORWARD it to NVC

Great news! Does this mean you dont have to do i824? I am still waiting on the service request. What else should i do to get the same response as you?

Yes i am not filing I-824 which delay case and cost money that one of the case i request an expedite in case because USCIS gave me so many different answer and I was confused. So when i called tier 2 I told them to give me an expedite request which result of USCIS asking to sent evidence why they should expedite my case. I explained that my case was approved but has never been sent to NVC. Then contacted NVC they never had my case and you know the whole story from now. I called them like every other day asking him them to sent my case to NVC that my mother does not live in USA but in Cameroon so she will seek to adjust her status there. So when my case was closed on September 1st was so confused and then they reopened on the 24 then i called again that when i was told i was sent an RFE which showed online today requesting to clarify where the beneficiary will adjust their status. So i respond in a letter way and include my mother ID from my country showing her address. So USCIS updated the case saying the received the Response to RFE and resume working to me case.

1- Where is your case at? Mine was transferred to Queen NY Field Office.

2- Do you have MyUSCIS Account? If not create one right now and add your case on it

3- I will keep calling until you get an answer about your case. dont file the I-824 until they tell you to do so

4- do not apply for B-2 VISITOR VISA FOR YOUR MOTHER EITHER

Once you have an account to can sent a quick email to them requesting to why your case was reopened.

Using the correct terminology is critical when dealing with USCIS.  If you have been telling them all this time that your mother will "adjust status", that could be part of the reason why USCIS is getting confused with your mother's case and not sending it to NVC.  Adjusting status is only for people who are already in the US.  Beneficiaries who are outside the US cannot adjust status.

 

For your future communications with USCIS, please remember to tell them that your mother will not be adjusting status and that she is actually applying for a visa via consular processing in Cameroon.

They might send you letter but with them it is plenty of fish in the ocean. Never know what to expect. This is frustrating and if you don’t heard anything by this week send your I-824 in an expedite way

In the RFE they ask me to clarify where she is seeking to adjust status either in the USA or Consular.

I got an update today that my request to send the case to NVC will be processed by the long island office:

 

“Your concern about having the petition forwarded to the National Visa Center (NVC) will be addressed by the field office that adjudicated the petition, the Long Island Field Office (LNY). You will receive correspondence when the typographical error has been resolved.”

 

I also see my case status being reopened.

Mine was well was reopened today so i will see what is next. I am just waiting on GOD now to have my case move forward. the waiting time is stressful

I got the approval notice today stating that they have approved and sent it to NVC. They may take up to 45 days to send it to counslar... 

Does anyone know what is the next step? 
With EO ban, where does the case sit? NVC or consular?
