We just got a Request for Initial Evidence from USCIS

Hello all,

 

We filed for my husband's adjustment of status (immediate relative/spouse). He is on a F-1 visa (currently on OPT) and I am a US born citizen. 

 

We just received a notice "Request For Initial Evidence". I have attached the notice below for reference. 

 

  • USCIS is asking for a copy of my husband's birth certificate, but we already provided them with a copy of NADRA issued birth certificate (CRC) in the original filing. Do we need to provide anything else apart from the birth certificate to prove his birth in Pakistan. I have attached a copy of the birth certificate below as well.

 

  • The second issue is in the 864/864a forms, specifically with the household member promising to sponsor us. We share the same mailing address as my mom (household member promising to sponsor us - I-864A),  but me and my husband live in our own place. And I am not a dependent on my mom's tax documents anymore. We need the help from my mom for sponsorship. How do we satisfy USCIS in this situation?

You did provide them with a NADRA birth certificate, but this is not the same as CRC (Child Registration Certificate, a.k.a. "B-Form")

 

You can send in a copy of his "B-Form", Passport Biodata copy (also has name, father's name, DOB), and school certificates.  The Matric certificate has one's name, date of birth, and father's name as well, so that is commonly used to supplement a birth certificate in Pakistan.

 

Does he have a pre-NADRA birth certificate?  Your scan shows that there is an "OLD/M REG NO.", which means there was a old/manual/pre-NADRA birth certificate.  That could also be helpful.

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
