Hi All,

I have been waiting to get my K1 visa, so I can travel to the USA and marry my fiancé. I have a dependent child who is aging out as she is reaching her 21st birthday very soon. Us consulate is not doing any regular visa processing due to lockdown in India. I have already informed US Consulate about my situation but they provided me below reply.


“Please write to us with this case-specific question after the consulate has resumed regular visa services. The consulate is unable to reply substantively about case-specific questions at this time.

My daughter will age out soon and lose her eligibility to travel to the US with me.

Any guidance is appreciated in this matter.

This may be an uphill battle unfortunately, I haven't seen any sign of New Delhi's consulate issuing any K visas since the shutdown. Consulates are being encouraged to do something for anyone who might age-out of their visa categories, but I haven't heard much for K-2s in particular. What stage is your case at? Is at the embassy already, did you have an interview scheduled but later cancelled? How soon is their birthday?

I realize now that Mumbai is probably the consulate that issues K1, not New Delhi. Regardless, I haven't seen any sign of them doing Ks either. I don't see any clear instructions for how to request an emergency appointment with the immigrant visa unit, only for non-immigrant visas. You can try emailing again, emphasizing the fact that you're requesting an emergency appointment due to a derivative K-2 applicant who is likely to age-out of their visa eligibility before routine appointments resume.

I had submitted reply to 221g in last december. my daughter birthday is in next month.
