Well some of you know that Craig and I have been having quite a few problems over the past year, it certainly hasn't been easy. Well, finally, something has gone right for us. Today I was issued my emergency AP!!! :D So we'll be able to go back to London to give our evidence at trial.

For those seeking an Emergency AP, or those just curious, here's how it went:

We had an original appointment for Monday 20th March at the local office in Omaha. Well, they were closed due to snow, so we were told to come back another day. Closed Tuesday as well, they don't see people on Wednesdays, Craig had surgery on Thursday, so we finally got in last Friday 24th.

After about a 5 minute wait we were called up to the window, it was an officer we know fairly well (they know us by name now :) ). We explained the situation to her and she checked the status of my AP on her computer and confirmed that they hadn't touched it since Jan. She then sent an email to a contact of hers at the NBC to see what the hold-up with it was. I thought that was all she was going to do to start with, but she must have seen the desperation on my face, because she said "Well, we do sometimes issue Emergency documents in certain circumstances". She asked for our evidence so we showed her the letter from the Witness Protection Unit confirming the trial dates and that if we did not attend they would issue a summons compelling us to, and if you don't go then you could be found in Contempt of Court etc. Also a letter from the Crown Prosecution Service showing that they had booked our flights for us and our accommodation for the duration of the trial and thanking us for our continued cooperation etc. She also asked for 2 photographs and a copy of the receipt for the I-131 to prove that we had applied and that it was paid for. She seemed pretty happy at this point, I guess because she could clearly see that it was an emergency and not just a holiday. She then got us to fill out a fresh I-131 and she took it to her boss who approved it in 2 minutes. She then ran it over to the biometrics office down the hallway, and told us that they'd have it ready for collection on Monday morning :)

Well, we didn't get in yesterday, but go in today, Tuesday and there it was in an envelope waiting for me at the front desk. 3 copies, so I guess that it is valid for more than one trip :) So relieved, you cannot imagine!!

A few words of advice if anyone else is attempting Emergency AP:

1) It does have to be an emergency. My sense was that if you just want it now because you have a vacation booked, they don't consider that an emergency.

2) Have plenty of clear evidence and photocopies of that for them to keep

3) Bring passport photographs, again several of them

4) Your receipt notice!!! VERY IMPORTANT and also photocopies of it for them to keep

5) Be very polite. don't go in there and demand to know why your AP hasn't arrived yet. They're not doing the processing, so it is not there fault for delays at the service centres. When we arrived a couple were at the window literally yelling at them, demanding to know why their case is moving slowly, demanding to see the manager of the place etc. I felt really bad for them, as it really is not their fault at all. Believe me, the yelling couple did not get anywhere with them!!!

16th December 2005 - Sent I-130, AOS, EAD & AP USPS overnight to Chicago Lockbox

18th December 2005 - Received at Chicago 9.18pm.

23rd December 2005 - NOAs for I-130, AOS, EAD, AP!! Didn't expect them that quickly

13th January 2006 - RFE for Medical and additional I-864 info

17th January 2006 - INFOPASS Apt about RFE.

23rd January 2006 - Appointment notice for Biometrics on 10th Feb.

10th February 2006 - Biometrics Appointment

21st February 2006 - Medical. Cost $250 including all blood tests, Td Shot, TB test and Titers for MMR and Varicella.

27th February 2006 - Appointment with immigration lawyer re. RFE for I-864.

1st March 2006 - Final results Medical. Papers in hand to send.

10th March 2006 - RFE responses to Lees Summit

13th March 2006 - RFE responses signed for at Lees Summit

24th March 2006 - Emergency AP approved in Omaha

28th March 2006- Collected AP

31st March 2006 - EAD Approval online

7th April 2006 - EAD arrived in mailbox.

21st April 2006- Received Interview Date for 22nd June

9th May 2006- Received SSN

22nd June 2006- AOS INTERVIEW APPROVED

REMOVING CONDITIONS

June 20 2008 - Package mailed to CSC under new rules. Would have been an NSC transfer

June 23 2008 - Package recieved at CSC

June 27 2008 - Recieve NOA1

July 16 2008 - Biometrics

July 17 2008 - Touched

September 9 2008 - Card production ordered

I do hope that all goes well back in the UK! What a relief that you were administered the emergency AP; yours is the sort of situation, in my opinion, that this alternative exists for. It's unfortunate you don't have a regular AP but it goes to show the moral of the story is be prepared, be polite and be persistent.
