Civil Surgeons and requirements for I-693

I noticed there is not a topic regarding I-693 and the best practices for getting this done smoothly. I have some questions regarding this that some of you might be able to answer and help me and others in the same situation. 

 

1. After you send the package without I-693, do you wait for an RFE or a notice of interview to do your medicals?

 

2. What if your TB is positive, that might delay the signature of I-693, wouldn't be better to have it done earlier in case you get a positive TB test?

 

3. Are there any civil surgeons that make antibody titers for those that do not have vaccine records? We should have a list of those surgeons because that certifies faster that you are "immune" to some diseases. For example varicella, I got it, but I have no way of proof, but showing the scars, etc.

 

Anyone that wants to follow the discussion, please feel free to do it. I saw some spread topics, but those are 2012 or older.

1. They will mail you a notice to tell you to bring i-693.

 

2. It is up to you.

 

3. civil surgeons want quick money, they take your word for it. If you had Varicella, they will mark VH for it, no need to test.

You probably couldn't find the topic here because this part of the forum is specific for K1 people doing AOS, and we don't do the medical inside the US, so we don't fill out the 693.

 

I'll report to the moderators so they can move your post to the right place so you can get better answers.

You have the option to take it to the interview: "Applicants may submit the Form I-693 medical examination report to USCIS: Concurrently with the immigration benefit application; or At any time after filing the immigration benefit application but before USCIS finalizes adjudication of that application. If not submitted simultaneously with the immigration benefit application, applicants may bring the medical examination report to an interview or wait until USCIS issues an RFE requesting the medical examination report." https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-4

In a few cases, they must see a Civil Surgeon. Some reasons include the overseas medical revealing a Class A condition or filing I-485 1 year after the overseas medical occurred: https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-3

"K and V nonimmigrants applying for adjustment of status are not required to repeat the medical examination if the application was filed within one year of the date of the original medical examination, and:

  • The medical examination did not reveal a Class A medical condition; or
  • The applicant received a conditional waiver in conjunction with the K or V nonimmigrant visa or the change of status to V and the applicant submits evidence of compliance with the waiver terms and conditions.

If a new medical examination is required and reveals a Class A medical condition, a new waiver application will also be required. In such cases, the officer should determine whether the applicant complied with the terms and conditions of the first waiver, if applicable. Such determination should be given considerable weight in the adjudication of a subsequent waiver application.

Even if a new medical examination is not required, applicants must still comply with the vaccination requirements if the vaccination record was not included as part of the original medical examination report. If the vaccination report was properly completed at the time of the overseas examination, the officer may accept the vaccination assessment completed by the panel physician. 

An applicant’s overseas medical examination report completed by a panel physician should already be in the applicant’s A-file. If it is not in the A-file, the officer should request the medical examination report through a Request for Evidence (RFE).

If the applicant was granted a change of status to V in the United States, the medical examination report completed by the civil surgeon should be in the A-file created at the time that the change of status was initially granted."

Thank you for the answers. I wonder strategically, would it be better to do the appointment with the civil surgeon before I get the notice, in case something happens?

 

1. Let's say you do not have hepatitis vaccinations. These are three doses which must be separated with at least a month. Would that delay signature, anyone has experienced this? 

2. Let's assume your blood test is TB positive, then they do saliva test positive, the civil surgeon will want you to do the treatment before they sign. That might take at least 6 months. Anyone has had this issue before. 

 

Those are the two potential delaying scenarios I see and that one could avoid delays by doing the civil surgeon appointment earlier. Any comments about the above questions? Anyone has experienced delays because of these two?
