F Student visa with K1 approved

Hello community!

 

First, apologies If this hs been covered before, I could not find an answer before!

 

I'll keep it short. K1 visa NOA2 june 30th. As many of us, stuck here and no good perspectives. Is it possible to apply and get an F visa for a semester to study a master in the USA?

One semester?  That would arouse suspicion in itself, imo....a CO could see this as an attempt to usurp the immigration system.......

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Don’t complicate your situation, you make it more difficult when it comes to adjust status.

N400

12/06/2014: Package filed

12/31/2014: Fingerprinted

02/06/2015: In-Line for Interview

04/15/2015: Passed Interview

05/05/2015: Oath letter was sent

05/22/2015: Oath Ceremony

I would hang in there, applying for an F-1 at this point will complicate your application and raise red flags to the CO.

It would not work... and it seems like you are looking for other options to immigrate to the US. The best you can do is hanging in there with the K-1

If you have the ESTA priviledge (I assume you do if you're from Spain), then the F-1 denial will stop you from using ESTA to visit the US. Any denied US visa results in ESTA denial, so to me it wouldn't be worth the risk. In the end it's up to you, but it's very likely that a F-1 visa will result in a denial.

I haven't got NOA2 for K1 visa... 100 days since NOA1 but been thinking about applying for a master program for next year fall. If I'm determined to pursue it, it is better to withdraw I-129F petition now? or will it still complicate my status adjustment?

If you're genuinely interested in pursuing a masters and not trying to skip ahead, I would speak to an immigration lawyer who can advise the best way to ensure you can adjust for a new visa without it appearing like you're trying to game the system.

USCIS advertises that you are not out of normal processing if you are within seven months. You are still facing a few more months. Keep in mind that USCIS doesn't promise a date that they will finish with your case, only a decision. This is a game of patience. There are some before you that have waited over a year and some up to three years for an approval. Just saying.
