Renew EAD + AP / K1 visa

Hello everybody,

 

I would like to get your advice / feedback on my situation. I came to the US on a K1 visa last year, I got married in July 2019 in Idaho, got my work and travel authorization card in December then found a job and moved to Missouri in June 2020. My work and travel authorization card expire in mid-December 2020. I was supposed to get an interview at the USCIS in Idaho but, because of the virus and then because of the move to Missouri, I am in a situation where I have to renew my work and travel authorization card.

 

- Regarding the I-131 form:

 

1) In Part 2, Application type, I don't know what to choose between 1.a (I am a permanent resident or conditional resident of the United States, and I am applying for a reentry permit" OR 1.b (I am applying for an Advance Parole Document to allow me to return to the United States after temporary Parole Document). I think it's 1.d but would love to get some feedback
2) I'm not planning any trips outside of the US for quite a long time and I've never left the US since I got here and got married so, just to make sure, I don't need to complete Part 3 and Part 4 right?
3) I have a question on Part 5 "Complete only if applying for a Re-entry Permit". Do I need to complete this whole part number 5? I know I did not fill out this part when I first sent this document after getting married so should I do it now that I want to renew it?

4) I moved out of state from Idaho to Missouri so should I be sending this I-131 form to the same address when I first sent the whole I485 package after getting married last year?

5) If I don't receive a renew travel authorization before it expires, do I need to receive it if I have a travel plan or is there any way to make it work with USCIS?

 

- Regarding the I-765 form:

6) I have read that, after sending the documents to renew this I-765 form, I will get a 180 days extension and I just wanted to confirm it with the community

All your answer are gonna be the same as your first set of forms, the exception is the on the 765 you will select renewal.

 

1) you're not a permanent resident yet. The correct option is 1.d.

 

2) I don't remember exactly what those questions are, but the form it pretty straight forward and will tell you what to fill out or not.

 

3) Again, you're not applying for a reentry permit, you're not a resident yet.

 

4) yes, you will send it to Chicago. The address is on the USCIS website.

 

5) you need to have a valid Advance parole document before you leave the US. Since there's no extension for AP, you will need to wait for it to be approved and delivered to you.

 

6) yes, NOA 1 for EAD will serve as an extension letter. Just for the EAD though.
